<br />ORDINANCE NO <br /> <br />57-04 <br /> <br />BY· Corrigan, Demro, Dever, <br />Dunn, FitzGerald, Mdigan, Seelie. <br /> <br />AN ORDINANCE fixing the compensation of the Clerk of the Lakewood Municipal Court, the <br />time and method of payment <br /> <br />WHEREAS, the Municipal Court Act, Ohio Revised Code Section190 1.31 provides that the <br />legislative authority of this municipality shall fix the arumal salary of the Clerk of Courts; and <br /> <br />WHEREAS, the Act further provides that the compensation of the Clerk shan be paid three-fifths <br />from the City Treasury and two-fifths from the Treasury of the County in which the City is located; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the <br />earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED <br />CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of <br />the public property, health and safety, and to provide for the usual daily operation of municipal <br />departments in that fIxing the compensation of the Clerk of the Lakewood Mooicipal Court and directing <br />the time and method of payment effects savings and economies and improves public service Now <br />Therefore, <br /> <br />BE IT ORDAINED BY 1HE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1 That the compensation of the Clerk of the LalÅ“wood Municipal Court is hereby fIxed <br />at Sixty-Five Thousand Dollars per annum effective June 1, 2004, <br /> <br />Section 2 T,hat the Director of Finance is hereby authorized and directed to pay three-fIfths (3/5) <br />of the compensation of the Clerk, as herein fixed, from the City Treasury in semi-monthly or in equal <br />installments every two weeks <br /> <br />Section 3, That Ordinance No. 49-03 adopted July 9, 2003 and all other ordinances or parts of <br />ordinances inconsistent herewith shall be and are hereby repealed, <br /> <br />Section 4 It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all <br />such deliberation of the Council and of any of its committees that resulted in such formal action were in <br />meetings open to the public in compliance with all legal requirements, <br /> <br />Section 5 That this ordinance is hereby declared to be an emergency measure necessary for <br />the immediaté preservation of the public peace, property, health, safety and welfare in the City and for the <br />usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, <br />and provided it receives the affirmative vote of at least five (5) of its members elected to Council, this <br />ordinance shan take effect and be in force immediately upon its adoption by the COlUlCil and approval by <br />the Mayor otherwise, it shall take effect and be in force after the earliest period allowed by law <br /> <br />Adopted: jµ <br /> <br />7, 20rJ 'i <br /> <br />~:k <br /> <br />President of Council <br /> <br /> <br />µL~ 14~ <br />Clerk of Co <br /> <br /> <br />~ø'~ <br />Mayor ' <br /> <br />Approved: /Jr I/'M/ 1,.
