Placed on second reading <br />6/21/04} <br /> <br />ORDINANCE NO: 66-04A <br /> <br />BY: Corrigan, Demro. Dever, <br />FitzGerald; Madigan.. Seplie.. <br /> <br />AN EMERGENCY ORDINANCE to establish additional appropriations for current <br />expenses and other expenditures of the City of LakewoOd, State of ohio, for the fiscal <br />year ending December 31,2004. <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect atthe earliest date possible as set forth In ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it <br />Is necessary for the immediate preservation of the public property, health and safety, <br />and to provide for the usual daily operation of municipal departments In that this <br />Ordinance is necessary to complete projects planned for the year 2004. Now <br />Therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That Director or Finance is hereby authorized and director to <br />increase appropriations in the following funds by the amount stated below: <br /> <br />General Fund <br />Federal Forfeiture Fund <br />Capital Improvement Fund <br />Wastewater Coliection Fund <br />Workers' Compensation Fund <br /> <br />$3,000 <br />$24,903 <br />$90,000 <br />$2,360,000 <br />$17,000 <br /> <br />Section 2. That the Director of Finance is hereby authorized to draw <br />checks upon the City depositories for the amounts appropriated 'in this ordinance <br />whenever claims are presented, properly approved by the head of the <br />department for which the indebtedness is incurred, providing the President of <br />Council or his/her designees shall approve all claims of the City Council. <br /> <br />Section 3. In accordance with Article III, Section 12, of the Charter of the <br />City of Lakewood, Council hereby determines that the manner of giving notice of <br />the passage of this ordinance is to be by posting copies hereof for a period of not <br />less than fifteen (15) days in not less than five (5) of the most public places in the <br />City, which places have been determined by Council in Ordinance No. 55-59. <br /> <br />Section 4. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council and of any of its committees, that resulted in such formal <br />actions, were in meetings open to the public in compliance with all legal requirements. <br /> <br />Sèction 5. That this ordinance is hereby declared to be an emergency measure <br />necessary for the Immediate preservation of the public peace, property, health, safety <br />and welfare in the City and for the usual daily operation of the City for the reasons set <br />forth and defined in the preamble to this ordinance, and provided it receives the <br />affirmative vote of at least five (5) of its members elected to Council, this ordinance <br />shall take effect and be in force immediately upon its adoption by the Council and <br />approval by the Mayor otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br />
