<br />ORDINANCE NO. <br /> <br />68-04 <br /> <br />BY: Corrigan, Demro~ Dever, <br />Dunn, FitzGerald, Madigan, Seelie. <br /> <br />AN ORDINANCE tö amend section 501.99, Penalties for Misdemeanors, of the <br />Codified Ordinances of the City of Lakewood for the purpose of updating this section. <br /> <br />WHEREAS, the Ohio Revised Code now provides for increased fines for the <br />offense of Minor Misdemeanor and; <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECITONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipai departments in that fixing the fines <br />at the level authorized by state law provides revenues and economies for the City and <br />Lakewood Municipal Court. Now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That section 509.11, Penalties for Misdemeanors, of the Codified <br />Ordinances of the City of Lakewood, currently reading as follows: <br /> <br />501.99 <br /> <br />Penalties for Misdemeanors. <br /> <br />(a) Whoever is convicted of or pleads guilty to a misdemeanor shall be <br />imprisoned for a definite term or fined, or both, which term of imprisonment and <br />fine shall be fixed by the court as provided in this section: <br /> <br />Classification of <br />Misdemeanor <br />First Degree <br />Second Degree <br />Third Degree <br />Fourth Degree <br />Minor <br />(ORC 2929.21) <br /> <br />Maximum Term <br />of Imorisonment <br />6 months <br />90 days <br />60 days <br />30 days <br />No imprisonment <br /> <br />Maximum <br />Fine <br />$1000.00 <br />750.00 <br />500.00 <br />250.00 <br />100.00 <br /> <br />(b) Regardless ofthe penalties provided in subsection (a) hereof, an <br />organization convicted of an offense pursuant to Section 501.11 shall be fined, <br />which fine shall be fixed by the court as follows: <br /> <br />Type of <br />Misdemeanor <br />First Degree <br />Second Degree <br />Third Degree <br />Fourth Degree <br />Minor <br />Misdemeanor not specifically <br />ciassified <br />Minor Misdemeanor not <br />specifically classified <br /> <br />Maximum <br />Fine <br />$5000.00 <br />4000.00 <br />3000.00 <br />2000.00 <br />1000.00 <br /> <br />2000.00 <br /> <br />1000.00 <br />
