PLACED ON 2ND READING <br />9/20/04. <br /> <br />ORDINANCE NO. 82-04 <br /> <br />BY: Corrigan, Demro, Dever, Dunn. <br />FitzGerald, Madiga~, Spelie. <br /> <br />AN EMERGENCY ORDINANCE authorizing and directing the Director of Finance <br />(Director) to enter into an agreement with a licensed real estate broker to market <br />for sale the real property located at 1440 Arthur Avenue for a period of 120 days, <br />pursuant to Section 155..07 of the Codified Ordinances <br /> <br />WHEREAS. the City is the owner of real property located at 1440 Arthur Avenue; <br />and <br /> <br />WHEREAS, this Council has determined it is in the best interest of the City to seil <br />said real property and that such sale shail further the interests of the City and its <br />residents; and <br /> <br />WHE~EAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that tis ordinance <br />shail take effect at the earliest date possible as set forth in ARTICLE III, <br />SECTIONS 10 and 13 ofthe SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that It is necessary for the immediate preservation of the <br />public property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that this property is currently vacant and immediate <br />action is required Now, Therefore, <br /> <br />BE IT ORDAINED BY THE CiTY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Director of Finance (Director) is hereby authorizE)d and <br />directed, on behalf of the City, to solicit proposals from licensed real estate <br />brokers and to enter into an agreement with the broker deemed most responsive <br />determined by the Director, to market real property located at 1440 Arthur <br />Avenue for a period not to exceed 12Ô days, pursuant to Section 155..07 of the <br />Codified Ordinances <br /> <br />Section 2, That Director is hereby authorized and directed to enter into an <br />agreement for the sale of said real property upon presentation of an acceptable <br />offer as determined by the Director. <br /> <br />Section 3. That Director specificaily is authorized to negotiate and/or make <br />counter proposals to any offer to purchase said real property, and shail, upon the <br />close of the transaction, report to Council the details of the sale <br /> <br />Section 4. The Director shail make no representations or warranties <br />concerning the condition of the property, inciuding, but not limited to mechanical <br />systems. dry basement, foundation, structurai, or compliance with code, zoning <br />or building requirements. <br /> <br />Section 5. It is found and determined that ail formal actions of this Councii <br />concerning and relating to the passage of this ordinance were adopted in an <br />open meeting òf this Council, and that ail such deliberations of this Council and <br />of any of its committees that resulted in such formai action were in meetings <br />open to the public in compliance with ail legal requirements <br />
