PLACED ON <br />2ND READING 10/18/04. <br /> <br />ORDINANCE NO: <br /> <br />89-04 <br /> <br />BY: Corrigan, Demro~ Dever, Dunn, <br />FitzGerald, Madigan, Seelíe. <br /> <br />AN ORDINANCE to amend Chapter 1156 - Planned Development- of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood. <br /> <br />WHEREAS, the amendments to the Zoning Code promotes the development of and protects existing <br />residential uses found throughout the City thereby protecting property values; and <br /> <br />WHEREAS, the amendments to the Zoning Code encourages the orderly deveiopment and retention of <br />commercial uses in a manner consistent with the CommulJíty Visíon. <br /> <br />NOW THEREFORE BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That existing Subsection 1156.02, Location of Planned Developments, of the Codified <br />Ordinances of the City of Lakewood, now reading respectively as follows: <br /> <br />(a) For a commercial PD, at least fifty-one percent (51%) of the property or properties must be located in <br />the C1 Office, C2 Retail, C3 General Business District, or the MH MUltiple-Family, High Density Residential <br />District. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />(a) For a commercial PD, at least fifty-one percent (51%) of the property or properties must be <br />located in the C1 Office, C2 Retaii, C3 General Business, C4 Public School District, or the MH <br />Multiple-Family, High Density Residential District. <br /> <br />t <br /> <br />Section 2. That existing Subsection 1156.03, Standards for Review of a Preliminary PD Plan, of the <br />Codified Ordinances of the City of Lakewood, now reading respectiveiy as foliows: <br /> <br />(a) The proposed PD shall contain uses that are expressly permitted either by right or as conditional or <br />accessory uses in a C1 Office, C2 Retail, C3 General Business District, or the MH Multiple-Family, High <br />Density Residential District, in which the PD is located or as modified according taCb) below, but such <br />uses may be mixed within the planned development or within the same structure located in the PD¡ <br /> <br />shail be and the same is hereby amended to read as foilows: <br /> <br />(a) The proposed PD shail contain uses that are expressly permitted either by right or as <br />conditional or accessory uses in a C1 Office, C2 Retail, C3 Generai Business, C4 Public Schooi <br />District, or the MH Muitiple-Family, High Density Residential District, in which the PD is iocated <br />or as modified according to (b) below, but such uses may be mixed within the planned <br />deveiopment or within the same structure iocated in the PD; <br /> <br />Section 3.
