<br />ORDINANCE NO: <br /> <br />93-04 <br /> <br />BY: Corrigan, Demro, Dever, Dunn, <br />FitzGerald, Madigan, Seelie. <br /> <br />AN ORDINANCE authorizing the Mayor or his designee to enter into a Real Property Sale Agreement <br />with Board of Education of the lakewood City Schools and to receive One Dollar ($1.00) per parcel for the <br />sale of the property located on Cohassett Place (PP# 312-31-082 and 083) Lakewood, Ohio. <br /> <br />WHEREAS, the City of lakewood, as a result of the action by Lakewood City Councii, shall hold title <br />in fee simple to the property located on Cohassett Place (PP# 312-31-082 and 083) lakewood, Ohio; and <br /> <br />WHEREAS, it is in the public interest to see that this property be returned to an economically viabie <br />and tax generating use; and <br /> <br />WHEREAS, the Board of Education of the lakewood City Schools "Designing Our Schools Tor the <br />Next Fifty YearS' school facilities project desires to purchase said parceis for the expansion and <br />redevelopment of the current Garfield Elementary School site; and <br /> <br />WHEREAS, the Planning Commission at its meeting of October 5, 2004 unanimously voted to <br />approve and refer to City Councii final approval of said sale of the aforementioned parcels to the Board of <br />Education of the lakewood City Schools; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this <br />ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible <br />as set forth in ARTICLE III, SECTiONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that immediate action is necessary in order to facilitate the school project. <br /> <br />NOW THEREFORE BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. The Councii of the City of lakewood hereby authorizes the Mayor or his designee to <br />enter into a Real Property Sale Agreement with Board of Education of the lakewood City Schools and to <br />receive One Dollar ($1.00) per parcel for the sale of the property located on Cohassett Piace (PP# 312-31- <br />082 and 083) Lakewood, Ohio. <br /> <br />Section 2, The Councii of the City of lakewood hereby determines that entering into an <br />agreement to sell said property to the Board of Education of the lakewood City Schools is in the best <br />interest of the public health, safety, and welfare of the City of Lakewood. <br /> <br />Section 3. It is found and determined that all formal actions of this Councii concerning and <br />relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and any of its committees that resulted in such formal actions, were in <br />meetings open to the public in compliance with ail legal requirements. <br /> <br />Section 4.
