<br />i~i\ <br /> <br />~" <br /> <br />PLACED ON 1ST READING & REFERRED TO THE <br />COMMITTEE OF TRE WHOLE 10/17/05. <br /> <br />ORDINANCE NO. 102-05 <br /> <br />BY: Corrigan, Demro, Dever, Dunn, <br />FitzGerald, Madigan, Seelie. <br /> <br />AN EMERGENCY ORDINANCE to repeal Section 128.2311, Authority to Contract <br />for Central Collection Focillties. <br /> <br />WHEREAS, pursuant to Section 128.2311, Authority to Contract for Central <br />Collection Facilities, the City of Lakewood has entered into an agreement to join a <br />Regional Council of Governments, which then organized a municipal tax organization <br />known as RITA to act as agent in the collection of the local income tax; and <br /> <br />WHEREAS, the City of Lakewood has an Agreement with RITA through December <br />31, 2005; and <br /> <br />WHEREAS, the City of Lakewood desires to bring the responsibility of income tax <br />collection in-house; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it Is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments. Now Therefore, <br /> <br />BE IT ORDAINED BY CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That Section 128.2311, Authority to Contract for Central Collection <br />Facilities, currently reading as follows: <br /> <br />The City of Lakewood, having already entered into an agreement for the <br />establishment of a Regional Council of Governments pursuant to Ordinance 34-71, <br />which Council has organized a municipal tax collection agency known as the "Regional <br />Income Tax Agency," declares that the Board of Trustees of the Regional Income Tax <br />Agency is authorized to administer and enforce the provisions of this chapter as the <br />agent of the City of Lakewood, and the duties and authority of the Administrator <br />hereunder may be performed by the Board of Trustees of such agency through the <br />Administrator of such agency. However, the Administrator of such agency shall have no <br />authority to abate penalties or interest provided for in Section 128.1501 and Section <br />128.1502. <br /> <br />is hereby repealed effective December 31, 2005. <br /> <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br />Section 3. That this ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety <br />and welfare in the City and for the usual dally operation of the City for the reasons set <br />forth and defined in the preamble to this ordinance, and provided it receives the <br />
