Piaead <br />on 2® Reading ].2/5/05.) <br /> <br />ORDINANCE NO, lO7-O5 <br /> <br />FitzGerald, Madigan, Seelie. <br /> <br /> AN ORDINANCE creating a new section, titled ProhibiUons on Residency, within <br />Chapter 533, Sex Offenders, of the Codified Ordinances of the City of Lakewood for the <br />purpose of prohibiting an.y person who is required to register as a sexua!!y odented <br />offender and classified as a "sexual predator" or whose conviction was of a "child-victim <br />oriented offense" to reside within one-thousand (t,000) feet of a school, library, park or <br />municipally owned recreational facility, and to create criminal penalties for a violation of <br />such prohibition. <br /> <br /> WHEREAS, there is deep concern within Lakewood regarding recent occurrences <br />in our City where children were assaulted; and <br /> <br /> WHEREAS, children are especially v]Jlnerable to being victims of sexually abusive <br />behavior and abduction, and are likely to be present a significant amount of time on or <br />near school premises, libraries and parks; and <br /> <br /> WHEREAS, the evidence regarding rates of recidivism for released sex offenders <br />is alarmingly high, eapedally for those who commit their crimes against children; and <br /> <br /> WHEREAS, Lakewood must maintain its reputation as a City with excellent <br />schools that is welcoming to families with children; and <br /> <br /> WHEREAS, the Ohio General Assembly recently amended the Ohio Revised Code <br />to prohibit registered sex offenders and child-victim oriented offenders from living <br />within one thousand feet of any school premises; and <br /> <br /> WHEREAS, this Council must use its authority to establish a policy that provides <br />the greatest protection for the children of Lakewood. Now, therefore, <br /> <br />BE ~F ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That a new sectiorJ within Chapter 533, Sex Offenders, of the <br />Codified Ordinances of the City bf Lakewood, titled Prohibitions on Residency, is hereby <br />enacted to read as follows: <br /> <br /> _Prohibitions on Residency <br /> (a) It is unlawful for any person who is required to register as a sexually <br />oriented offender under ORC §2950.04 and classified as a "sexual predator" or whose <br />conviction was of a "child-victim oriented offense" as those terms are defined by ORC <br />§2950.01, to reside within one-thousand (1;000) feet of a school, library, park or <br />municipally owned recreation facility. <br /> <br /> (b) Any person who violates this section is guilty of a misdemeanor in the first <br />degree. <br /> <br /> (c) This section applies to any person registering on or after the effective <br />date of this legislation. <br /> <br /> <br />
