772.02 LIGHTS DURING REGULATED PERIOD. <br />No person being the owner or in charge or control of any store other place of business~ shall cause <br />or permit the parking lot, show window, or interior display lights to burn or be operated during any <br />time when the store or other business operation is required by this Business Regulation Code to be <br />closed, except that exterior electric lights may be operated in the area of each entrance, exit and <br />loading dock for purposes of and to the wattage necessary for security, and internal lights may b9 <br />operated to the extent necessary for maintenance and security of the premises. Passed <br />7-17-00.) <br /> <br />772.03 LIGHTED SIGNS. <br />No person, being the owner or in charge of any sign or advertising device lighted or illuminated by <br />electricity, or any electric light illuminating any building or structure from the outside, which sign or <br />advertising device or electric light is utilized by or in conjunction with a store or other business <br />operation which is subject to and defined in Section 772.01, shall operate or illuminate any such <br />sign, advertising device or electric light during any time when the store or other place of business is <br />required to be dosed by Section 772,01 except as permitted by Section 772.02. Passed <br />7-17-00.) <br /> <br />772.04 APPEAL PROCESS. <br />Any owner or operator of a store or other place of business located in a C-1, C-2 or C-3 district <br />pursuant to subsections (a) and (b) who desires to operate between the hours of 12:00 a.m. and <br />6:00 a.m., may apply to the Planning Commission for a Conditional Use Permit, pursuant to Section <br />1171.03. No Conditional Use Permit shall be issued unless the Planning Commission finds that the <br />applicant's proposed use is consistent with the criteria defined in Sections 1173.02(b), 1129.14 and <br />1161.03. (Ord~ 41-00, Passed 7-17-00,) <br /> <br />772.99 PENALTY. <br />Whoever violates any provision of this chapter is guilty of a fourth degree misdemeanor for a first <br />offense and a misdemeanor of the first degree for each subsequent office. (Ord. 41-00. Passed 7- <br />17-00.) <br /> <br />is hereby-repealed effective December 31, 2005. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this ordinance were adopted in an open meeting of this Council, and that alt such <br />deliberations of this Council and of any of its committees that resulted in such formal action were in <br />meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 3.
