<br />curbs and driveway approaches; preparing the surface and resurfacing; improving Clifton <br />Avenue by constructing bus pads, where. necessary; improving Andrews Avenue, Detroit <br />Avenue, Elbur Avenue, LarchmontAvenueand Parkside Street by reconstructing sections of the <br />pavement base; preparing the surface and resurfacing, where necessary, and improving Elbur <br />Avenue and Kirtland Lane by reconstructing and rehabilitating pavement joints, where <br />necessary, in each case together 'with the necessary appurtenances and work incidental. thereto <br />($376,751); (0) acquiring and installing traffic signs, signals, devices and related equipment <br />($58,902); (P) acquiring and installing computers and other related equipment for the collection, <br />storage and communication of information used' and useful in City operations ($63,347); <br />(q) improving City streots by landscaping, planting and removing trees thereon ($15,559); <br />(r) acquiring and installing traffic signalization devices ($10,558); (s) acquiring and installing <br />communications equipment ($151,700); (t) constructing, reconstructing and rehabilitating <br />sidewalks on certain designated streets in the City ($76,684); (u) improving facilities of the <br />Department of Public Works ($183,374); (v) improving recreational facilities ($38,898); <br />(w) constructing and equipping an animal shelter ($64,459); (x) acquiring vehicles and <br />equipment for the Fire Department ($23,227): (y) improving City streets by planting trees <br />thereon ($15,559); (z) acquiring and installing computer eqnipment ($1,111) <br /> <br />As used herein, the following terms shall have the following meanings·, <br /> <br />"Bond Purchase Agreement" means the agreement between - the City and the <br />Original Purchaser entered into in cormection with the purchase. of the Bonds and authorized <br />pursuant to Section 5 of this Ordinance, <br /> <br />"Bond Retirement Fund" means the bond retirement fund of the City <br /> <br />"Bonds" means the portion of the issue of the City's Various Purpose General <br />Obligation Bonds,- Series 2005 issued pursuant to the authority gr.anted and the terms established <br />in this Ordinance; <br /> <br />"Book"-entry form" or "Book-entry system" means a fonn or system under which <br />(i) the beneficial right to principal and interest may be transferred only through a book entry and <br />(Ü) physical Bonds in registered form are issued only to a Depository or its nominee. as registered <br />owner, with the Bonds "immobilized" to the custody of the Depository, and the book entry is the <br />record thatidentifies the ownerS ofbenefieìal interests in thatprincipal and interest <br /> <br />"Certificate of Award" means the certificate executed by the Fiscal Officer in <br />C01lllection with the issuance. and sale of the Bonds which contains the terms set out at Section 6 <br />of this Ordinance <br /> <br />"Depository" means any securities depository that is a clearing agency under <br />federal law operating and maintaining a Book-entry system to record beneficial ownership of the <br />right to principal and interest, and to effect transfers of Bonds; in hook-entry form, and includes <br />and means initially The Depository Trust Companý (a limited purpose trust company), New <br />York, New York. <br /> <br />"Earliest Optional Redemption Date" mea1)S the date, if any, specified as the <br />earliest optional redemption date for the Bonds in the Certificate of Award, <br /> <br />"Fiscal Officer" means the Director of Finance of the City or his designee, <br /> <br />"Interest Payment Date" means a date on which interest owing on the Bonds is <br />due, as determined in accordance with the Certificate of Award. <br /> <br />"Mandatory Redemption Dates" means, as to any of the Bonds which are Term <br />Bonds, the date specified in the Certificate of Award as the dates on which such Term Bonds are <br />to be redeemed through the application of Mandatory Sinking Fund Redemption Requirements <br /> <br />"Mandatory Sinking Fund Redemption Requirement" means the amount of the <br />principal of the Bonds that is required to be paid, plus interest accrued to theredemption date, on <br />any Mandatory Redemption Date <br /> <br />{KLF2993;2} <br /> <br />2 <br />
