Seelie. <br /> <br />An EMERGENCY ORDINANCE authorizing the Director ofPI:umiug and <br />Development to enter jnto an agreement pursuant to Section 307.15 of the Ohio Revised Code <br />with other member jurisdictions of the Cuyahoga Housing Consortium regarding the cooperative <br />implementation and carrying out of the goals and purposes of the Federal Home Investment <br />Partnership Program and declaring an emergency. <br /> <br />WHEREAS, the Congress of the United States enacted the Cranston-Gonzales <br />National Mfordable Housjng Act of 1990 (the "Act"), which created the Home Investment <br />Partnership Program (herein the "HOME Program") to provide funds to states and local <br />governments for acquisition, rehabilitation and new construction of affordable housing and <br />tenant-based rental assistance; and <br /> <br />WHEREAS, the HOME Program's general purposes include an expansion of the <br />supply of decent, safe, sanitary and affordable housing for low income Americans, by <br />strengthening the abilities of states and local governments to design and implement affordable <br />housing strategies; and <br /> <br />WHEREAS, the U.S. Department of Housing and Urban Development ("HUÐ"), <br />subsequeIÍtly issued regnlations set forth in 24 CFR Part 92 (the "Regulations"), establishing the <br />requirements for the operation'of,fue HOME Program and allowing units of general local <br />goveI111Ùent to enter into agreements for mutual cooperation to fönn consortiums for the purpose <br />of obtaining funding ftom the HOME Program; and <br /> <br />WHE~AS, the City has previously entered into such a cooperative agreement <br />with Cuyahoga Coil,nty and the Cities of Cleveland Hejghts, Euclid, Lakewood and Parma <br />(which jurisdictions are collectively refeITed to herein as the "Consortjum") and has detennined <br />to continue its participation in the Consortium by authorizing the execution of the agreement that <br />is the subject ofthjs Ordinance (the "Agreement"); and <br /> <br />WHEREAS, this Council has detennined that the development of affordable <br />housing in the City and the other objectives of the Act are best met through the cooperative <br />participation of Cleveland Heights, Euclid, Lakewood, Parma and Cuyahoga County in the <br />Consortium; and <br /> <br />WHEREAS, The City has authority to enter into the Agreement pursuant to <br />Section 307.15 of the Ohio Revised Code; and <br /> <br />WHEREAS, this Ordinance is an emergency. measure necessary for the <br />immediate preservation of the public peace, property, health, safety and welfare of the City and <br />for the further reason that it is immediately necessary to provide for execution of the Agreement <br />pursuant to the timeline established in accordance with HUÐ Regulations and thereby eusure that <br />the City, as part of the Consortium, will contiuue to qualify for the distribution of federal funds <br />in connection with the HOME Program; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. The Director of Planning and Developmènt is hereby authorized and directed <br />to execute on behalf of the City the Agreement among the members of the Cuyahoga Housing <br />Consortium (the "Consortium") in substantially the fonn of the agreement attached hereto as <br />Exhibit A, together with such changes as are not inconsistent with this Ordinance and not <br />substantially adverse to the City, and as are approved by the,Law Director of the City. <br /> <br />Section 2, It is hereby found and detennined that all fonnal actions of this Council <br />concerning and relating to the passage of this Ordinance were taken in an open meeting of this <br />Council, and that all deliberations of this Council and of any of its cornmittees that resulted in <br />those formal actions were in meetings open to the public, in compliance with the law. <br />
