An EMERGENCY ORDINANCE authorizing the Director ofPI:umiug and Development to enter jnto an agreement pursuant to Section 307.15 of the Ohio Revised Code with other member jurisdictions of the Cuyahoga Housing Consortium regarding the cooperative implementation and carrying out of the goals and purposes of the Federal Home Investment Partnership Program and declaring an emergency. WHEREAS, the Congress of the United States enacted the Cranston-Gonzales National Mfordable Housjng Act of 1990 (the "Act"), which created the Home Investment Partnership Program (herein the "HOME Program") to provide funds to states and local governments for acquisition, rehabilitation and new construction of affordable housing and tenant-based rental assistance; and WHEREAS, the HOME Program's general purposes include an expansion of the supply of decent, safe, sanitary and affordable housing for low income Americans, by strengthening the abilities of states and local governments to design and implement affordable housing strategies; and WHEREAS, the U.S. Department of Housing and Urban Development ("HUÐ"), subsequeIÍtly issued regnlations set forth in 24 CFR Part 92 (the "Regulations"), establishing the requirements for the operation'of,fue HOME Program and allowing units of general local goveI111Ùent to enter into agreements for mutual cooperation to fönn consortiums for the purpose of obtaining funding ftom the HOME Program; and WHE~AS, the City has previously entered into such a cooperative agreement with Cuyahoga Coil,nty and the Cities of Cleveland Hejghts, Euclid, Lakewood and Parma (which jurisdictions are collectively refeITed to herein as the "Consortjum") and has detennined to continue its participation in the Consortium by authorizing the execution of the agreement that is the subject ofthjs Ordinance (the "Agreement"); and WHEREAS, this Council has detennined that the development of affordable housing in the City and the other objectives of the Act are best met through the cooperative participation of Cleveland Heights, Euclid, Lakewood, Parma and Cuyahoga County in the Consortium; and WHEREAS, The City has authority to enter into the Agreement pursuant to Section 307.15 of the Ohio Revised Code; and WHEREAS, this Ordinance is an emergency. measure necessary for the immediate preservation of the public peace, property, health, safety and welfare of the City and for the further reason that it is immediately necessary to provide for execution of the Agreement pursuant to the timeline established in accordance with HUÐ Regulations and thereby eusure that the City, as part of the Consortium, will contiuue to qualify for the distribution of federal funds in connection with the HOME Program; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. The Director of Planning and Developmènt is hereby authorized and directed to execute on behalf of the City the Agreement among the members of the Cuyahoga Housing Consortium (the "Consortium") in substantially the fonn of the agreement attached hereto as Exhibit A, together with such changes as are not inconsistent with this Ordinance and not substantially adverse to the City, and as are approved by the,Law Director of the City. Section 2, It is hereby found and detennined that all fonnal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council, and that all deliberations of this Council and of any of its cornmittees that resulted in those formal actions were in meetings open to the public, in compliance with the law.
