AN EMERGENCY ORDINANCE authorizing and directing the Director of Finance to sell, through pubIJc auctions, various obsolete, surplus and non-functioning City vehicles, materials and/or equipment. WHEREAS, it is in the best interest of the City to se] this obsolete, surp'lus and nQn-functioning equipment to make better use of the space it occupies and t¢ realize a profit from the sale, and 'Ii , !~: WHEREAS, this Council by an affirmative vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE Iii. SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THEiCITY OF LAKEWOOD, and that it provides for the usual daily operation of municipal departments in that it is in the best interest of the City to Auction obsolete equipment due, to lack of physical storage at City Hall and delivery of new equipment, now. therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD. STATE OF OHIO' . . Section 1. That the Director of Finance be and he is hereby authori;¡;,ed and directed to sell. through public auctions, held in the spring and the fall, various obsolete, surplus and non-functioning City vehicles, materials and/or equipment after advertising ac'Cording to law Section 2 It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in' an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public in compJiance with all legal requirements Section 3. This. ordinance is hereby declared to be an emergency measure necessary for the daily operation of municipal departments in the City for the reasons set forth In the preamble to this ordinance, and provided it received the affirmative' vote of at le?st five (5) of Its members elected to Council. this ordinance shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor otherwise, it shall take effect and be in force after the earliest period allowed by law APPROVED; f1' "[ I 7 , ZûòS-- , ¡;;.~ ~~-C4.~..
