ORDINANCE NO: 5-06 <br /> <br />BY: <br /> <br /> AN EMERGENCY ORDINANCE to establish additional appropriations for current <br />expenses and other expenditures of the City of Lakewood, State of Ohio, for the fiscal <br />year ending December 31, 2006. <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the eadiest date possible as set forth in ARTICLE III, SECTONS 10 and 13 <br />of the SECOND AMENDED CHARTER OF THE C1TY OF U~,KEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in grant funds <br />awarded by the Ohio Attorney G~eneral's Office for the purchase of Livescan Computer <br />equipment will not be available after February 28, 2006. Now 'Therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That Director or Finance is hereby authorized and directed to <br />increase appropriations in the following funds by the amount stated below: <br /> <br />Capital Improvements <br /> <br />$40,000,00 <br /> <br /> Section 2. That the Director of Finance is hereby authorized to draw <br />checks upon the City depositories for the amounts appropriated in this ordinance <br />whenever claims are presented, properly approved by the head of the <br />departm.ent for which the indebtedness is incurred~ providing the President of <br />Council or his/her designees shall approve all claims of the City Council. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Coundl and of any of its committees, that resulted in <br />such formal actions, were in meetings open to the public in compliance with all <br />legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety <br />and welfare in the City and for the usual daily operation of the City for the reasons set <br />forth and defined in the preamble to this ordinam:e, and provided it receives the <br />affirraative vote of at least five (S) of its members elected to Council, this ordinance <br />shall take effect and be in force immediate!y,upon its adoption by the <br />Council and approval by the Mayor Otherwise; it shall take effect and be in force after <br />the earliest period allowed by law. <br /> <br />President of Council <br /> <br />Clerk of ~i~uncil ~' <br /> <br />Approved: <br /> <br /> <br />
