"Portable wadingpool" means a family wading pool which may be <br /> dismantled, storedor moved from one place to another. <br />(2) "Permanent wading pool" means a family wading po01 which is built <br /> either upon or below the level of the ground and which is not <br /> designed or intended to be readily dismantled, stored or moved <br /> from one place to another. <br /> <br /> XXXX.03 CONSTRUCTZON PERMIT. <br /> Before work is commenced on the construction of a family swimming pool or any <br />alteration, addition, remodeling or other improvement thereto, an application for a <br />permit to construct and the plans and specifications and pertinent explanatory data <br />hereinafter required shall be submitted to the Building Commissioner for approval. No <br />part of the work shall be commenced until the Commissioner of Health and the Building <br />Commissioner have evidenced their approval by a suitable endorsement upon such <br />plans and specifications, and have granted a ~ermit thereof. <br /> <br /> XXXX.04 FEES, <br /> .(a) , Per.mi.ts. The fee for the permit to construct a swimmingpool shall be at <br />the rate of tour oollars ($4.00) per 100 square feet, or fraction thereof, of the ground <br />area occupied by the pool structure, With a minimum fee of twenty-five dollars <br />be$25.00). Such fee is in addition to permit fees applicable to other structures which may <br /> incidental to the pool, Or plumbing, Sewering or wiring connections therewith. <br />($30,0-0b)u- License. The fee for a license for a family pool shall be thirty dollars <br /> <br />XXXX.05 LICENSE TO OPERATE; TRANSFERABILITY; EFFECTIVE <br />PER~OD. <br /> No person shall operate or maintain a family swimming pool until a license <br />therefor has been issued by the Commissioner of Health. The license for a family <br />swimming pool shall be issued for an indefinite period but shall not be transferab e as to <br />person or location. All licenses shall be in writing and shall state the conditions thereof <br />and the term for which the license is granted, it shall be unlawful for any person to <br />conduct, operate, maintain or manage any swimming poOl without complying with the <br />requirements of this chapter, and the Divisions of Public Health and Building inspection <br />are charged with the enforcement of the provisions hereof. <br /> <br /> XXXX.06 REVOCATION OF LICENSE; APPEAL. <br /> Any license granted by the Commissioner of Health hereunder may be revoked <br />by him for failure to comply with rules and regulations promulgated hereunder or for <br />failure to comply with any provisions of this chapter, or whenever in the determination <br />of the CommissiOner of Health, further operat on under such icense creates a menace <br />to the health, safety or morals of the Users of the Swimming pool. The hoder of any <br />license which has been revoked may appeal to CoUncil in writing within thirty days of <br />such revocation, and Council Shall; at its next regUlar meeting, determine the legal [y or <br />reasonableness of the revocation. No appeal under this section, however, shall entiUe <br />the license holder to continue operation of the swimming pool pending action of <br />Council <br /> <br /> XXX~.07 INSPECTION. <br /> The Commissioner of Health shall inspect or cause to be inspected ail pools <br />within the City at such times as he may deem necessary to carry out the intent of this <br />chapter. The Commissioner Of Health, or his duly authorized representatives, is <br />authorized to enter upon any premises, private or public, to take samples of water from <br />the pools at such times as he may deem necessary and to require the owner, proprietor <br />or operator to comply with the provisions of this chapter, in the event of the fa lure of <br />compliance, after dUe notice, with any provisions of this chapter, the Commissioner of <br />Health shall have the power to abate or cause a suspension of the use of such pool <br />until such time as the same is, in the opinion of the Commissioner of Health, no longer <br />a menace or a hazard to health, safety or morals. <br /> <br /> XXXX.08 COMPLIANCE WITH RE(~UIREMENTS OF STATE <br /> DEPARTMENT OF HEALTH. <br /> In the construction, operation and maintenance of any family swimming pool, <br />laws of the State of Ohio and the rules, regulations and requirements of the State <br />Department of Health shall be observed. ~n the event of any conflict between the <br />provisions of this chapter and any provision of State law or requirement, rule or <br />regulation of the Ohio Department of Public Health, the provision imposing the higher <br />standard or the more stringent requirement shall be controlling. <br /> <br />XXXX.09 SAFETY PRECAUTIONS. <br /> <br /> <br />
