<br />adverse to the City, and which shall be approved by the Director of Law. The Mayor or his <br />designee, alone or together, for and in the name of this City, are hereby authorized to execute <br />that Agreement,aud the approval of changes thereto by the birector of Law ànd the character <br />of tbose changes as not being substantially adverse to the City shall be evidenced <br />conclusively by their execution thereof <br /> <br />SECTION 2. This Council, for and on behalf of the City, hereby waives the <br />requirement in Section 5709 40 that the School District notifY the City not less than fourteen <br />(14) days prior to the passage of the ordinance authorizing the Development Agreement of <br />the School District's approval of the tax exemption granted by the Development Agreement <br />pursuant to said Section 5709.40 and determines that the respouse of the School District shall <br />be taken into account as ifit were received within the fourteen (14) day time period provided <br />in said Section 5709.40 <br /> <br />SECTION 3 It is hereby found and determined that all formal actions of this <br />Council concerning and relating to the passage of this Ordinance were passed in open <br />meetings of this Council, and that all such deliberations of tills Council and of any of its <br />committees that resulted in any such fonnal action, were in meetings open to the public, in <br />compliance with all legal requirements including the City's Charter and CodifIed Ordinances. <br /> <br />SECTION 4. This Ordinance is hereby deClared to be an emergency measure <br />necessary for the reasons set forth and defined in the preamble to this Ordinance, and <br />provided it receives the affinnative vote of at least five (5) of its members elected to Council, <br />this Ordinance shall take effect and be in force immediately upon its passage by the Council <br />and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. . <br /> <br />paSSed:?J., 11 <br /> <br />,2006 <br /> <br />9~.~ <br /> <br />President of Council <br /> <br />1Z1~ 7.
