<br />by Company, over the network of the Company, and which is compatible with the <br />technology or protocol utilized by Còmpany to deliver IP Video Services. <br /> <br />3.2 Use of Capacity. As1y programming made available under Section 3.1 shall <br />bð soldy for noncommercial public, governmental and educational purposes. All <br />programming shall be the responsibility of the City and· the Company shall not exercise <br />any editorial control over any public, governmental or educational access programming <br />made available under Section 3.1. <br /> <br />3.3 Emergencv Message. The Company shall provide an appropriate <br />rebroadcast of any text message provided by the City on the IP Video Service in the <br />event of a public safety emergency declared by the Emergency Alert System. <br /> <br />3.4 PEG Capital Support. To assist the City in managing its PEG production <br />facilities and in digitizing and placing its PEG content on a secure server that is open to <br />the Company's platform, the Company shall make a one-time payment of $16,000 to the <br />City. Further, within thirty (30) days of the City's written request, the Company shall, <br />at its cost, provide suitable facilities necessary to connect the Company's IP-based <br />facilities to Lakewood High School, where Internet sourced PEG content will be <br />prepared. The Company shall further, at its sole cost, provide transport for such PEG <br />content between the Lakewood High School and the Company's IP-based facilities. The <br />Company's obligation herein will begin èither when its IP Video Service within the <br />Service Area of the City reaches 1,000 subscribers or 18 months after the IP Vidèo <br />Service is first provided in the City, whichever comes later. The Company shall have <br />the right to charge its subscribers for the cost of the PEG support it provides to the City. <br /> <br />The general design description of the PEG digitization, connection, and transport <br />mechanisms to be utilized pursuant to the foregoing is attached as Appðndix C. <br />Additional design details ánd standards will be mutually agreed upon by the City and'the <br />Company, subject to reasonable economic and technical feasibility considerations, and <br />shall, within ninety (90) days of the Effective Date of this Agreement, be reduced to å <br />writing to be attached to this Agreement as Appendix C-l. The City has the right to <br />terminate the Agreement if the parties do not complete Appendix C-l within this time <br />period. <br /> <br />3.5 Service to Schools and Public Buildings. It is the City's intention that <br />each accredited primary and secondary sCl100l building, each City governnient building, <br />and ðach public library building be provided with cable service, IP Video Service or <br />similar service at no cost; and that the burden of providing such connections be shared by <br />all cable and IP Video Service providers in the City in an equitable manner. The <br />Company will offer óne free installation and free monthly IP Video Service to one outlet <br />at each pìlblic school, City government building, fire station, police station, and library <br />building that is passed by the Company's system. The Company shall have the <br />responsibility to offer a free installation and free monthly IP Video Service to a share of <br />such schools, governmental, or library buildings.
