<br />PLACED ON 1ST READING & REFERRED TO THE <br />PUBLIC WORKS COMMITTEE 10/2/06. <br /> <br />Ordinance No. 62-06 <br /> <br />BY: Antonio~ Butler, Demro~ Dever~ FitzGerald, <br />Madigan, See lie. <br /> <br />AN ORDIDNANCE to take effect immediately provided it received the affirmative vote of <br />at least five (5) members elected to Council otherwise, it shall take effect and be in force after the <br />earliest period allowed by law, authorizing and directing the Mayor, or his designee to enter into an <br />agreement with City Architecture Incorporated for professionai services relating to a Detroit Avenue <br />Streetscape Study with a specific emphasis on the Downtown area not to exceed $93,750. <br /> <br />WHEREAS, numerous development projects are occurring along Detroit Avenue, and; <br /> <br />WHEREAS, Detroit Avenue is scheduled for improvements, and; <br /> <br />WHEREAS, that section of Detroit Avenue between Arthur and Bunts has been identified <br />as the City of Lakewood's Downtown District, and; <br /> <br />WHEREAS, the City of Lakewood's Downtown District has been accepted by Downtown <br />Ohio, Inc. as one of 34 participants statewide into the Main Street Program, and; <br /> <br />WHEREAS, the City of Lakewood would greatly benefit from further study of strategies <br />to improve the pedestrian access and aesthetics of the Detroit Avenue streetscape; and <br /> <br />WHEREAS, Northeast Ohio Areawide Coordinating Agency (NOACA) administers <br />financial assistance provided by the U.S. Department of Transportation's Federal Highway <br />Administration, and; <br /> <br />WHEREAS this Council previously approved Resolution No. 8078-06 authorizing an <br />application for Transportation for Livable Communities financial assistance with NOACA and to <br />obligate the funds required to satisfactorily complete the proposed project and become eligible for <br />reimbursement under the terms and conditions of the Transportation for Livabie Communities fund; <br />and <br /> <br />WHEREAS, the City of Lakewood has been awarded a grant by NOACA in the amount of <br />$75,000 that requires a match of $18,750; and <br /> <br />[ <br /> <br />WHEREAS, Lakewood Community Progress, Incorporated (LCPI) has agreed to <br />contribute one-half of the City's required matching funds to this project; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this Ordinance is an emergency measure, and that this Ordinance shall take effect at <br />the earliest datè possible as set forth in ARTICLE III, SECTIONS 10. and 13 of the SECOND <br />AMMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate <br />preservation of the public property, health, and safety, and to provide for the usual daily operation of <br />municipal departments, thereby stabilizing the community and improving the quality of life within the <br />City. NOW, THEREFORE, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Mayor is his designee is herebý authorized to enter into an <br />agreement with City Architecture Incorporated for professional services relating to the Downtown <br />District Streetscape Project not to exceed $93,750. <br /> <br />Section 2. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal requirements. <br /> <br />Section 3. That this Ordinance Is her€by declared to be an emergency measure <br />necessary for the usual daily operation of the City for the reasons set forth and defined in the <br />preamble to this ordinance, and provided it receives the affirmative vote of at least five (5) of its <br />members elected to Council, this Ordinance shall take effect and be in force immediately Upon its <br />
