<br />PLACED ON{lST READING& REFERRED TO THE <br />CWB¥IÇßj¡ro¡l!!{SCi1@M¡1;Iimi:~E1',Ø1 '/.106. <br /> <br />ORDINANCE 63-06 <br /> <br />BY: Antonio, Butler, Deroro~ Dever, <br />FitzGerald, Madigan, Seelie. <br /> <br />AN ORDINANCE to take effect immediately provided it received the affirmative vote of <br />at least five (5) members elected to Council otherwise, it shall take effect and be in force after the <br />earliest period allowed by law, authorizing the Mayor, or his designee, to enter into an agreement <br />with Behnke Associates, Incorporated (BAI) for professional services for the further study of <br />pedestrian access to the Clevèland Metroparks via Hogsback Lane in an amount not to exceed <br />$40,000. <br /> <br />WHEREAS, Hogsback Lane Serves as a main access point into the Cleveiand Metroparks <br />for approximately 2,700 Lakewood households residing in the adjacent neighborhoods; and <br /> <br />WHEREAS, pedestrian access from the adjacent Lakewood neighborhoods into the <br />Cleveland Metroparks via Hogsback Lane is hazardous due to inadequate pedestrian facilities and <br />traffic controls; and <br /> <br />WHEREAS, residents of the City of Lakewood would greatly benefit from further study <br />of public improvements necessary to enable pedestrian access to the Cleveland Metroparks via <br />Hogsback Lane; and <br /> <br />WHEREAS, Northeast Ohio Areawide Coordinating Agency (NOACA) administers <br />financial assistance provided by the u.s. Department of Transportation's Federal Highway <br />Administration, and; <br /> <br />WHEREAS, this Council previously approved Resolution No. 8089-06 providing that the <br />Mayor, on behalf of the City, to be authorized and directed to execute and file an application for <br />Transportation for Livable Communities financial assistance with NOACA and to provide all <br />information and documentation required to become eligible for possible funding assistance while <br />obligating the funds required to satisfactorily complete the proposed project and become eligible for <br />reimbursement under the terms and conditions of the Transportation for Livable Communities fund; <br />and <br /> <br />WHEREAS, the City of Lakewood has been awarded a grant by NOACA in the amount of <br />$32,000 that requires a match of $8,000; and <br /> <br />WHEREAS, Kamms Corner Development Corporation, the City of Cleveland, and <br />Cleveland Metroparks Board have agreed to contribute a portion of the City's required matching funds <br />to this project; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this Ordinance is an emergency measure, and that this Ordinance shall take effect at <br />the earliest date possible as Sèt forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND <br />AMMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate <br />prèservation of the public property, health, and safety, and to provide for the usual daily operation of <br />municipal departments, thereby stabilizing the community and improving the quality of life within the <br />City. NOW, THEREFORE, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Mayor, or his designee, is hereby authorized to enter into an <br />agreement with Behnke Associates, Incorporated (BAI) for professional services for the further study <br />of pedestrian access to the Cleveland Metroparks via Hogsback Lane in an amount not to exceed <br />$40,000. <br /> <br />Section 2. It is found and determined that all formal actions of this Council concerning <br />and reiating to the passage of this Ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal requirements. <br /> <br />Section 3. That this Ordinance is hereby declared to be an emergency measure <br />necessary for the usual daily operation of the City for the reasons set forth and defined in the <br />
