For any inspections made for the issuance of a Certificate of Occupancy, there shall be charged. a fee of fifty dollars ($50.00) for residential and seventy-five dollars ($75.00) for commercial. 1309.12 REFUSAL TO ISSUE PERMIT; APPEAL. The Building Official may deny any applicant a permit who-has outstanding violations that have not been corrected as of the date an additional permit is requested, or if past performance indicates a pattern of noncompliance with an applicable building ordinance. In the event the application far a permit is denied, the applicant shall be notified of such refusal in writing, and such notice shall be sent by certified mail to the applicant at the address of the applicant, as set forth in the application for a permit. The applicant shall have ten days after receipt of such notice within which to appeal the refusal. Such appeal shall be perfected by filing a written notice of appeal with the Director of Public Safety. Thereupon the applicant shall have not less than ten days notice of the date and place of the hearing. The appeal shall be heard by the Board of Building and Zoning Code Appeals or by the Board of Building Standards if such is existing at the time of the refusal by the Building Official. The Board shall have the power after such hearing to confirm the refusal or order the permit to be issued. 1309.13 AGGREGATE FLOOR AREA. For the purposes of this chapter, the aggregate floor area shall be the sum of the gross horizontal areas at the several floors, including basements, cellars and attics that are at least fifty percent (50%) habitable. All horizontal dimensions shall be taken from the exterior faces of walls, including enclosed porches. 1309.14 COST ESTIMATES. Where the permit is based upon cost of the work done under the permit, such costs shall be the actual cost as certified by the owner or authorized representative of the owner, and as approved by the Building Inspector. The Building Inspector may, at any time up to three months after the completion of the work, require the submission of authoritative estimates or actual cost data to substantiate the estimated cost stated in the application, and require the payment. of additional fees when it is demonstrated that the actual cost of the. work is in excess of the estimated cost upon which permit fees were based. 1309.15 PLANS EXAMINER FEE. Whenever the Building Commissioner determines that an examination of construction plans by a professional plans examiner is necessary for the enforcement of the Building Code or required by other applicable law, there shall be charged a fee of one hundred and fifty dollars ($150.00), plus three dollars ($3.00) per 100 square feet, or part thereof, of the proposed structure, and an additional fee in the amount of one hundred percent (100%) of the original plans examination fee for all resubmittals. Shall be and is hereby amended to read as follows: 1309.01 PAYMENT PROCEDURE. The fees to be paid for building permits shall be determined by the Building Commissioner in accordance with the following schedule and shall be noted upon the, application when approved for the issuing of the permit. Such fees are to be paid to the Building Department which, upon receipt of such fees, shall issue the permit to the applicant. The fees to be paid shall be as are provided in this chapter.
