ORDINANCE NO. 87-06 <br /> <br /> PLACED ON 1ST READING& REFERRED TO THE <br /> RULES & ORDINANCES COMMITTEE 11/20/06. <br /> SECOND READING 12/4/06. <br /> <br />BY'Antonio, Butler, Demro, Dever, <br /> <br /> AN ORDINANCE to create a new section within Chapter 144, Civil Service <br />Commission, of the Codified Ordinances of the City of Lakewood to set out the <br />order of lay-off of a civil service position. <br /> <br /> WHEREAS~ this ordinance is necessary in that any Rules and Regulations <br />of the Eakewood Civil Service Commission which differ from the Ohio Revised <br />Code must be enacted by ordinance; and <br /> <br /> WHEREAS, based on the experience of the Civil Service Commission and <br />their extensive review of the Rules and Regulations, the Commission <br />recommends that the order of lay-off be reflected as described in the proposed <br />ordinance. Now, therefore <br /> <br />BE 1T ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That a new Section within Chapter :144, Civil Service <br />Commission, of the Codified Ordinances Of the City of Lakewood is hereby <br />created to read as follows; <br /> <br />144.XX ORDER OF LAY-OFF <br /> <br /> (a) The appointing authority shall determine the number of employees within <br />each class to be laid off. All lay:offs within each such class must proceed in the <br />following order: <br /> <br />1. Employees serving temporary or emergency appointments; <br /> <br />2. Seasonal employees; <br /> <br />3. Part-time employees; <br /> <br />Provisional appointees who have not completed their <br />probationary period. <br /> <br />Provisional appointees who have completed their <br />probationary period. <br /> <br />Employees certified from eligible list who have not completed their <br />probationary period; <br /> <br />Full-time permanent employees certified from eligible list who have <br />the least amount of seniority. <br /> <br /> (b) Subsection (a) hereof is Specifically intended to supersede State Code <br />provisions on the order of lay-off of a civil service position. <br /> <br /> <br />
