ORDINANCE NO. 87-06 PLACED ON 1ST READING& REFERRED TO THE RULES & ORDINANCES COMMITTEE 11/20/06. SECOND READING 12/4/06. BY'Antonio, Butler, Demro, Dever, AN ORDINANCE to create a new section within Chapter 144, Civil Service Commission, of the Codified Ordinances of the City of Lakewood to set out the order of lay-off of a civil service position. WHEREAS~ this ordinance is necessary in that any Rules and Regulations of the Eakewood Civil Service Commission which differ from the Ohio Revised Code must be enacted by ordinance; and WHEREAS, based on the experience of the Civil Service Commission and their extensive review of the Rules and Regulations, the Commission recommends that the order of lay-off be reflected as described in the proposed ordinance. Now, therefore BE 1T ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That a new Section within Chapter :144, Civil Service Commission, of the Codified Ordinances Of the City of Lakewood is hereby created to read as follows; 144.XX ORDER OF LAY-OFF (a) The appointing authority shall determine the number of employees within each class to be laid off. All lay:offs within each such class must proceed in the following order: 1. Employees serving temporary or emergency appointments; 2. Seasonal employees; 3. Part-time employees; Provisional appointees who have not completed their probationary period. Provisional appointees who have completed their probationary period. Employees certified from eligible list who have not completed their probationary period; Full-time permanent employees certified from eligible list who have the least amount of seniority. (b) Subsection (a) hereof is Specifically intended to supersede State Code provisions on the order of lay-off of a civil service position.
