Please substitute for 89-06 <br />(Placed on 1st reading 11-20-06 <br />and referred to R & O; Placed <br />on 2nd reading 12-4-06) <br /> <br />ORDINANCE NO. 89-06 BY: <br /> <br />FitzGerald, Madigan, Seelie; <br /> <br /> AN ORDINANCE to create a new section within Chapter 144, Civil Service <br />Commission, of the Codified Ordinances of the City of Lakewood to set out <br />abolishment of a civil service position. <br /> <br /> WHEREAS, this ordinance is necessary in that any Rules and Regulations <br />of the Lakewood Civil Service Commission which differ from the Ohio Revised <br />Code must be enacted by ordinance; and <br /> <br /> WHEREAS, based on the experience of the Civil Service Commission and <br />their extensive review of the Rules and Regulations, the Commission <br />recommends that the abolishment of positions be reflected as described in the <br />proposed ordinance. Now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That a new Section within Chapter 144, Civil Service <br />Commission, of the Codified Ordinances of the City of Lakewood is hereby <br />created to read as follows: <br /> <br />144,XX ABOLISHMENT OF POSITIONS <br /> <br />(a) When a position above the class of Patrol Officer in the Division of Police <br />and above the class of Firefighter in the Division of Fire is abolished, the officer <br />with the least time of service in that class shall be reduced to the next lower <br />class and the officer with the least time of service in the next lower class shall be <br />reduced and so on down until the officer with the least time of service has been <br />reached, who shall be laid off. <br /> <br />(b) Whene~er the incumbent in a classified position is dismissed due to the <br />abolishing of such position, he or she may be placed by the Commission on an <br />eligible list. In the event of the re-establishment of such position, said person <br />shall be certified from the eligible list in the manner here and before provided. <br />Applicants must furnish evidence of military service to qualif~ under this section, <br />including certified military records. <br /> <br />(c) Subsections (a) and (b) hereof are specifically intended to supersede State <br />Code provisions on the abolishment of a civil service position. <br /> <br /> Section 2. It ]s found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action were in meetings <br /> <br /> <br />
