PLACED ON 1ST READING & REFERRED TO <br />THE HEALTH & HU~L~N SERVICES COMMITTEE <br />1/16/07. <br /> <br />ORDINANCE NO. 3-07 <br /> <br /> BY: Antonio~ Butler, Demro, <br />Dever, FitzGerald~ Madigan. <br /> <br /> AN ORDINANCE to take effect immediately provided it received the affirmative vote of <br />at least five (5) members elected to Coundl otherwise, it shatl take effect and be in force after <br />the eaNiest period allowed by ~aw, requesting CounciFs specific approval of and authorizing the <br />Mayor to enter into a lease for property located at 17400 Notthwood Avenue, Lakewood, Ohio <br />for use by the Division of Early Childhood ("Division") in the Department of Human Services, in <br />accordance with Lakewood Codified Ordinance §111.04(a)(4). <br /> <br /> WHEREAS, the ~ivision of Early Childhood is currently located at 17400 Northwood <br />Avenue; and <br /> <br /> WHEREAS, the Division of Early Childhood has been operating at said location without a <br />formal written lease since 1994 and it is in the best interest of the City and the Department of <br />Human Services, Division of Eady Childhood Development to enter into a written lease <br />agreement with the Diocese of Cleveland to ensure its continued daily operation; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as Bet forth in ARTICLE Iii, SECTONS 10 and 13 of the <br />SECQND AMENDED CHARTER OF THE CZTY OF LAKEWOOD, and that it is necessary for the <br />immediate preservation of the public properly, health and safety, and to provide for the usual <br />daily operation of municipal department in that this lease begins January 1, 2007. Now <br />Therefore, <br /> <br />BE EF ORDAINED BY THE CTFY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. Lakewood City Council hereby authorizes the Mayor to enter into a <br />Lease Agreement for the Lease of Property consisting of administrative office space <br />located at 17400 Northwood Avenue for a term of one year with one additional option <br />term of one year, at the option of the City, <br /> <br /> Section 2, Lakewood City Council hereby spedfically approves the Lease <br />Agreement by and between Most Rev, Richard G. Lennon, Bishop of the Roman Catholic <br />Diocese of Cleveland as Trustee for St. ]ames Church, 17514 Detroit Avenue, <br />Lakewood, Ohio and the City of Lakewood, Ohio¢ 12650 Detroit Avenue, Lakewood, <br />Ohio (attached hereto as Exhibit "A"). <br /> <br /> Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open meeting of <br />this Council, and that all such deliberation of the Coundl and of any of its committees that <br />resulted in such formal action were in meetings open to the public in compliance with all legal <br />requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual daily operation of the City for <br />the reasons set forth and defined in the preamble to this ordinance, and provided it <br />receives the affirmative vote of at least five (5) of its members elected to Council, this <br /> <br /> <br />
