departments and other officials or employees of the City may fully <br />participate (a) in their respective official capacities in the deliberations by <br />the City or its agencies, and (b) in their capacity as members or officials of <br />such organization of governments, special unit of government, <br />organization of governmental offidals or nonprofit corporation, including <br />the right to vote with respect to such contract, job, work, service or other <br />transaction. Any willful violation of this Section shall constitute <br />malfeasance in office, and any such officer or employee found guilty <br />thereof by a court of law shall forfeit his or her office. <br /> <br />Section 3, The ballots for said election shall, at the top thereof, be <br />entitled "Proposed Charter Amendment, City of Lakewood" and the <br />question to be submitted on said ballot shall be in the following words: <br />"Shall Article )0([][, General Provisions, of the Second Amended Charter of <br />the City of Lakewood, be amended to permit employees of the Lakewood <br />Board of Education to seek public office in the City of Lakewood." <br /> <br />Section 4. Notice of the proposed municipal charter amendment may be <br />given by newspaper advertising as is provided by law. <br /> <br />Section 5. The Clerk of Council is directed to ~:ertif,/a copy of this <br />ordinance to the Board of Elections of Cuyahoga County, and to take all <br />further action required by law relative to the submission of said <br />amendment to the electors at said election. <br /> <br />Section 6. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the public peace, health, safety, and welfare of the <br />citizens of the City of Lakewood, the immediate emergency being the <br />necessity of forthwith submission of the proposed charter amendment to <br />the electors of the City of Lakewood as provided by law. Therefore, this <br />Ordinance shall be in full force and effect immediately upon its passage. <br /> <br />Section 7. That the forgoing proposed amendment shall become effective <br />immediately upon its adoption. <br /> <br />Section 8. It is found an determined that all formal action of this Council <br />concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council and any of its committees that resulted in <br />such formal actions, were in meetings open to the public, in compliance <br />with all legal requirements. <br /> <br /> Section 3. Notice of the proposed municipal charter amendment may be given <br />by newspaper advertising as is provided by law. <br /> <br /> Section 4. The Clerk of Council is directed to certify a copy of this ordinance <br />to the Board of Elections of Cuyahoga Cgunty, and to take all further action required by <br />law relative to the submission of said amendment at said election. <br /> <br /> Section 5. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the preservation of the public peace, health, safety, and welfare <br />of the citizens of the City of Lakewood, the immediate emergency being the necessity <br />of forthwith submission of the proposed Charter Amendment to the electors of the City <br />of Lakewood as provided by law. Therefore, this Ordinance shall be in full force and <br />effect immediately upon its passage and approval by the Mayor. <br /> <br /> Section 6. That the foregoing proposed Amendment shall become effective <br />immediately upon its adoption. <br /> <br /> <br />
