(Please substitute for 45-07 put on for <br />1st reading 5-7-07, referred to Public <br />safety; 2"d reading 5-21-07) <br /> <br />ORDINANCE NO. 45-07 <br /> <br /> BY: AntOnio, <br />Butler, Demro~ FitzGerald, Madigan, <br /> <br /> AN ORDINANCE to take effect immediately provided it received the <br />affirmative vote of at least five (5) elected members of Council, or <br />otherwise to take effect and be in force after the earliest period allowed <br />by !aw, amending Section 509.12 of the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood relating to the curfew within <br />the City. <br /> <br /> WHEREAS, sodeb/has changed greatly duritlg the past forty years <br />and our youth now face very different challenges and environments, and <br /> <br /> WHEREAS, this body is also confronting issues regarding the <br />maintenance, planning, and policing of our public parks, and <br /> <br /> WHEREAS, we deem it appropriate for this body to revise the <br />current curfew as it relates to minors within our City. Now therefore <br /> <br /> BE El' ORDAINED BY THE C1TY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 509,12 of the General Offenses Code of <br />the Codified Ordinances Of the City of Lakewood, currently reading as <br />follows: <br /> <br />509.12 CURFEW <br /> <br />(a) No child under the age of fifteen years shall be upon the streets or sidewalks <br />or any public property within the City between the hours of 11:00 p.m. and 4:00 <br />a.m. of the following morning; nor shall any child of or over the age of fifteen <br />but under the age of eighteen year~ be upon the streets or sidewalk or any <br />public property within the City between the hours of 12:30 a.m. and 4:00 a.m. <br />However, the provisions of this sectionldo not apply to a minor accompanied by <br />his parent, guardian or other adult person having the care and custody of the <br />minor, or where the minor is upon an emergency errand or legitimate business <br />directed by his parent, guardian or other adult person having the care and <br />custody of the minor, <br /> <br />(b) No parent or guardian of any child under the age of fifteen years shall allow <br />such child to be on the streets or sidewalks or any public property within the City <br />between the hours of 11:00 p.m, and 4:00 a.m. of the following morning, nor <br />shall any parent or guardian of any child of or over the age of fifteen but under <br />the age of eighteen years allow such child to be upon the streets or sidewalks <br />between the hours of 12:30 a.m. and 4:00 a.m. However, the provisions of this <br />section do not apply to a minor accompanied by his parent or guardian or to any <br />other adult person having the care and custody of the minor, or where the minor <br />is upon an emergency errand or legitimate business directed by his parent or <br />guardian or by any other adult person having the care and custody of the minor. <br /> <br /> <br />
