(Please substitute for 45-07 put on for 1st reading 5-7-07, referred to Public safety; 2"d reading 5-21-07) ORDINANCE NO. 45-07 BY: AntOnio, Butler, Demro~ FitzGerald, Madigan, AN ORDINANCE to take effect immediately provided it received the affirmative vote of at least five (5) elected members of Council, or otherwise to take effect and be in force after the earliest period allowed by !aw, amending Section 509.12 of the General Offenses Code of the Codified Ordinances of the City of Lakewood relating to the curfew within the City. WHEREAS, sodeb/has changed greatly duritlg the past forty years and our youth now face very different challenges and environments, and WHEREAS, this body is also confronting issues regarding the maintenance, planning, and policing of our public parks, and WHEREAS, we deem it appropriate for this body to revise the current curfew as it relates to minors within our City. Now therefore BE El' ORDAINED BY THE C1TY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 509,12 of the General Offenses Code of the Codified Ordinances Of the City of Lakewood, currently reading as follows: 509.12 CURFEW (a) No child under the age of fifteen years shall be upon the streets or sidewalks or any public property within the City between the hours of 11:00 p.m. and 4:00 a.m. of the following morning; nor shall any child of or over the age of fifteen but under the age of eighteen year~ be upon the streets or sidewalk or any public property within the City between the hours of 12:30 a.m. and 4:00 a.m. However, the provisions of this sectionldo not apply to a minor accompanied by his parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his parent, guardian or other adult person having the care and custody of the minor, (b) No parent or guardian of any child under the age of fifteen years shall allow such child to be on the streets or sidewalks or any public property within the City between the hours of 11:00 p.m, and 4:00 a.m. of the following morning, nor shall any parent or guardian of any child of or over the age of fifteen but under the age of eighteen years allow such child to be upon the streets or sidewalks between the hours of 12:30 a.m. and 4:00 a.m. However, the provisions of this section do not apply to a minor accompanied by his parent or guardian or to any other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his parent or guardian or by any other adult person having the care and custody of the minor.
