PLACED ON iST READING & REFERRED TO <br />THE FINANCE COMMITTEE 5/7/07/ <br />PLACED ON 2ND READING 5/21/07. <br /> <br />ORDINANCE NO 46-07 BY' Antonio, Butler, Demro, <br /> Madigan, Seelie. <br /> <br /> AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and be <br />in force after the earliest pedod allowed by law, authorizing and directing the Director of <br />Finance to sell on an ongoing basis, through public auctions, various obsolete, surplus <br />and non-functioning City vehicles. <br /> <br /> WHEREAS, it is in the best interest of the City to sell this obsolete, surplus and <br />non-functioning vehicles on an ongoing basis, and <br /> <br /> WHEREAS, this Council by an affirmative vote of at least five (5) members <br />elected thereto determines that this ordinance is an emergency measure, and that this <br />ordinanc~ shall take effect at the earliest date possible as set forth in ARTICLE Ill, <br />SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it provides for the usual daily operation of municipal departments <br />in that it is in the best interest of the City to Auction obsolete equipment due to lack of <br />physical storage at City Hall and delivery of new equipment, now, therefore, <br /> <br />BE I~' ORDAINED BY THE CITY Of LAKEVVOOD, STATE Of OHIO' <br /> <br /> Section 1 That the Director of Finance be and he is hereby authorized and <br />directed to sell on an ongoing basis, through public auctions, vadous obsolete, surplus <br />and non-functioning CRy vehicles after advertising according to law <br /> <br /> Section 2 It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that ail such deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings open to the public in <br />compliance with all legal requirements <br /> <br /> Section 3. This ordinance is hereby declared to be an emergency measure <br />necessary for the daily operation of municipal departments in the City for the reasons set <br />forth in the preamble to this ordinance, and provided it received the affirmative vote of at <br />least five (5) of its members elected to Council, this ordinance shall take effect and be in <br />force immediately upon its adoption by the Council and approval by the Mayor <br />otherwise, it shall take effect and be in force after the earliest pedod allowed by law <br /> <br />ADOPTED: <br /> <br />APPROVED: <br /> <br />President <br /> <br />Clark <br /> <br /> <br />
