PLACED <br />ON 2ND READING 7/16/07. <br /> <br />ORDINANCE NO. 60-07 <br /> <br />BY: <br /> <br />FitzGerald, Madigan, Seelie. <br /> <br /> AN ORDINANCE to amend Section 903.07, Nonconforming Sidewalks, of the <br />Codified Ordinances of the City of LakewoOd, for the purpose of requiring property <br />owners to maintain and repair sidewalks and driveway aprons and regulating the <br />materials tO be used for sidewalks and driveway aprons. <br /> <br /> WHEREAS, the current ordinance needs to be amended to address other <br />nonconforming materials that are inappropriate for use in repairing or replacing <br />sidewalks. <br /> WHEREAS, in the interest of public safety, it is fittng to require proPerty owners <br />to maintain sidewalks uniformly and appropriately. Now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEVVOOD, STATE OF 0HIO <br /> <br /> Section 1. That Section 903.07 NoncOnforming Sidewalks, of the Codified <br />Ordinances of the City of Lakewood, currently reading as folloWs: <br /> <br /> With respect to sidewalks heretofore a d within the City not in conformity with <br />the requirements of this chapter, there is reserved tO the City such rights as are <br />granted to the City by the statutes of the State to require such walks to be relaid or <br />repaired n conformity with the provisions of this chapter <br /> <br />shall be and is hereby amended to read as follows: <br /> <br />903.07 NONCONFORMING SIDEWALKS <br /> <br /> The City may require sidewalks laid not in conformity wth the requirements of <br />this chapter tO be re-laid or repa red in conformity with the provisions of this chapter. <br />The materials conforming to the requirements of this chapter are concrete or stone <br />flagging. Materials such as asphalt or pavers are not permitted for the repair or <br />replacement of Sidewalks. <br /> <br /> Section 2. R is found and determined that all formal actions of this Coundl <br />concerning and relating to the passage of this Ordinance were passed in an open <br />meeting of this Council and that all deliberations of this Council and any of its <br />committees that resulted in such actions were in meetings open to the public and in <br />compliance with legal requirements. <br /> <br />AdoPted:~oO7 <br /> <br />PRESIDENT <br /> <br /> <br />
