Placed on 2nd Reading and referred <br />back to the Housing Committee 9/4/07.) <br /> <br />ORDINANCE NO. <br /> <br />64-07 <br /> <br />BY: Antonio, Butler, Demro, Devet', <br />FitzGerald, Madigan, Seelie. <br /> <br />AN ORDINANCE to create a new Section 1501.17, Front or Side Yard Grilling and <br />Storage, of the Codified Ordinances of the City of Lakewood prohibit grilling within fifteen Feet <br />of the public right-oF-way. <br /> <br />WHEREAS, the Ohio Fire Code already prohibits griiling within fifteen Feet of a structure; <br /> <br />and <br /> <br />WHEREAS, currently there"are no restrictions on how close a person can operate a griil <br />to the public right-oF-way; and <br /> <br />WHEREAS, griiling too close to the public right-oF-way can create a risk of harm to <br />pedestrians and bicyclists using the public sidewaiks. Now, thereFore, <br /> <br />BE IT ORDAINED BY THE cm OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That a new Section 1501.17, Front or Side Yard Grilling and Storage, of <br />the Codified Ordinances of the City of Lakewood shali be enacted to read as Foliows: <br /> <br />(a) No person shall have an outdoor fire in an area abutting the public right-oF-way <br />uniess such fire is being utiiized to cook Food For human consumption, the fire is in an approved <br />container and is located at ieast 15 Feet From the public right-oF-way. . "Approved" shall have <br />the same meaning as stated in the Ohio Fire Code. <br /> <br />This subsection shall not appiy to outdoor fires being utiiized to cook Food For human <br />consumption in an approved container on any date and street For which a permit For a biock <br />party has been issued by the Director of Public Works. <br /> <br />(b) No person, tenant or leasehoider shalí store any portable or outdoor grill or <br />associated Fuel, or kindie in any multi-Family dweiling unit or on or below any balcony <br />constructed in conjunction therewith or within ten Feet of any structure housing more than <br />three Famiiies. <br /> <br />Section 2. It is Found and determined that all Formal actions of this Council <br />côncerning and relating to the passage of this ordinance were adopted in an open meeting of <br />this Council, ~nd that all such deliberation of the Council and of any of its <br />committees tll.at resuited in such Formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br />Adopted: (),,~ /!, .2001 <br /> <br />f?~.~ <br /> <br />7M a"''ð' '?
