<br />practical standards for storm water management and soil erosion and sediment control; <br />and, <br /> <br />WHEREAS, Title 40 Code of Federal Regulations (C.F.R.) Parts 9, 122, 123, and <br />124, referred to as NPDES Storm Water Phase II, require designated communities, <br />including the City of Lakewood, to develop a Storm Water Management Program to <br />address among other components, erosion, sedimentation, and the quality of storm <br />water runoff during and after soil disturbing activities; and, <br /> <br />WHEREAS, Article XVIII, Section 3 of the Ohio Constitution and Chapter 1511 of <br />the Ohio Revised Code grants municipalities the legal authority to adopt rules to abate <br />soil erosion and water pollution by soil sediments; and, <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety in <br />that this legislation must be implemented immediately to protect the quality of storm <br />water in the City of Lakewood. Now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That a new Chapter titled Storm Water Management within Part 13, <br />Building Code of the Codified Ordinances of the City of Lakewood is hereby enacted to <br />read as follows: <br /> <br />CHAPTER 1339 <br />Storm Water Management <br /> <br />1339.01 <br /> <br />PURPOSE AND SCOPE. <br /> <br />(a) The intent of this chapter is to establish technically feasible and <br />economically reasonable standards to achieve a level of storm water management, and <br />erosion and sediment control that will minimize damage to public and private property <br />and degradation of water resources, and will promote and maintain the health, safety, <br />and welfare of the residents of the City of Lakewood. The standards, or Best <br />Management Practices (BMP), referred to and re.quired by this chapter shall be in <br />accordance with the current version of the Ohio Rainwater and Land Develooment <br />Manual promulgated by the Ohio Department of Natural Resources. <br /> <br />(b) This ct1apter applies to all parcels and projects located within the City of <br />Lakewood that disturb an area greater than 8,000 square feet regardless of public <br /> <br />2 <br />
