PLEASE SUBSTITUTE FOR ORDINANCE N0. 86-07. <br />placed on 1ST REDING & REFERRED TO THE RULES <br />COMMITTEE 10/1/07, 2ND READING 10/15/07. <br />BY: BUTLER <br />& ORDINANCES <br />ANTONIO, BULLOCK, DEVER, MADIGAN, POWERS, <br />ORDINANCE NO 86-07 SUMMERS. <br />AN ORDINANCE to take effect immediately provided it received the affirmative vote of at <br />least five (5) elected members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, amending Section 1306.44 of the Codified Ordinances to add a <br />requirement that applicants for housing licenses identify adult tenants and the number of minor <br />tenants living in the residential property at the time of the application, <br />WHEREAS, income tax revenues are lost to the City of Lakewood when working tenants <br />living in non-owner-occupied homes fail to tender tax returns to the City and the City is unable to <br />identify them; and <br />WHEREAS, overcrowding in rental units is a violation of the Codified Ordinances and yet <br />is rarely tracked by the City due to the City's lack of information regarding tenants; and <br />WHEREAS, an updated code affecting housing licenses issued in the City of Lakewood <br />is necessary to ensure that the City can better eliminate zoning and building violations occurring <br />at properties throughout the City; and <br />WHEREAS, the City and its residents have a vested interest in ensuring that all tax rev- <br />enues are collected fairly from residents who utilize city services and that public safety officials <br />are able to eliminate zoning and building violations occurring at properties in Lakewood; and <br />WHEREAS, a requirement in the Codified Ordinances that landlords seeking housing <br />licenses report the identities of their adult tenants and the number of minor tenants to the City <br />will be beneficial to the people of Lakewood without being unduly burdensome on the landlords; <br />and <br />WHEREAS, the Ohio Constitution permits municipalities to exercise all powers of local <br />self-government and to adopt and enforce within their limits such local police, sanitary and other <br />similar regulations, as are not in conflict with general laws; <br />NOW, THEREFORE, be it ordained by the City of Lakewood, State of Ohio, that: <br />Section 1. That Section 1306,44 of the Codified Ordinances, currently reading as fol- <br />Iows <br />1306 44 LICENSE APPLICATION FORM AND FEE.. <br />(a) Every application for a housing license shall be on a form approved by <br />the official charged with the enforcement of this Code. It shall state the <br />name and address of the applicant, the nature and extent of his interest in <br />the building for which the license is required, the name and address of the <br />owner of the building, the location of the building, the number of rooms <br />therein, the number of dwelling units therein, the number of rooming units <br />therein and such other information as may be required by the official <br />charged with the enforcement of the Code. <br />(b) The housing license fees shall be as follows: owner-occupied condo- <br />minium units -two dollars ($2.00); nonowner-occupied condominium units <br />- six dollars ($6.00); owner-occupied three-family dwellings -twenty-five <br />dollars ($25.00) per dwelling unit or rooming unit; all non- owner-occupied <br />one and two-family dwellings seventy-five dollars ($75.00) per dwelling <br />
