<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Mayor (Director of Public Safety), the Director of Public <br />Works, the Director of Law, the Director of Finance, and/or the Purchasing Manager is <br />hereby authorized to engage Johnson Controls. Inc. to provide professional services for <br />the design, preparation of specifications, construction inspection and contract <br />administration for the following Infrastructure Improvements, contracts not to exceed <br />the specified amounts shown, except as hereinafter provided: <br /> <br />HB 300 Performance Contract Projects <br /> <br />$3,300,000 <br /> <br />Section 2. That the Mayor (Director of Public Safety), the Director of Public <br />Works, the Director of Law, the Director Df Finance, and/or the Purchasing Manager is <br />hereby authorized to enter into contracts as set forth above in amounts not to exceed <br />the specified amounts without further action from Council; and to enter into contracts in <br />excess of specified amounts only upon consent of Council evidenced by adoption of a <br />resolution specifying the authorized amount. <br /> <br />Section 3. The City Administration is hereby authorized to enter into a <br />Performance Contract with Johnson Controls, Inc. for the design and implementation of <br />the Installations in order to significantly reduce operating costs in buildings and utility <br />systems owned by the City. <br /> <br />Section 4. The City Administration is hereby authorized to arrange the <br />financing of the Installations for a project cost in an amount not to exceed three million, <br />three hundred thousand dollars and zero cents ($3,300,000). <br /> <br />Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br />Section 4. That this ordinance is hereby declared to be an emergency measure <br />necessary for the usual daily operation of the City for the reasons set forth and defined <br />in the preamble to this ordinance, and provided it receives the affirmative vote of at <br />least five (5) of its members elected to Council, this ordinance shall take effect and be <br />in force immediately upon its adoption by the Council and approval by the Mayor <br />otherwise, it shall take effect and be in force after the earliest period allowed by law. <br />
