z~ <br />PLEASE SUBSTITUTE FOR ORDINANCE N0. 2~-i~8 <br />PLACED ON 1ST READING & REFERRED TO THE PUBLIC <br />SAFETY COMMITTEE 2/19/08, 2ND REEDING 3/3/08. <br />r <br />ORDINANCE NO. 23-08 gy; Antonio, Bullock, Butler, Dever, <br />Madigan, Powers, Summers. <br />AN ORDINANCE to take effect immediately provided it receives the <br />affirmative vote of at least five (5) members elected to Council, otherwise, it <br />shall be in effect and be in force after the earliest period allowed by law, to <br />create a new Chapter 510 entitled "Nuisance Abatement" of the Codified <br />Ordinances of the City of Lakewood. <br />WHEREAS, the residents of the City of Lakewood have been adversely <br />affected by criminal activity that occurs repeatedly at, or originating from, certain <br />residential or commercial properties in the City; and <br />WHEREAS, repeated violations of law stemming from a single property <br />place an undue burden on the City's safety resources, and therefore, an undue <br />burden on taxpayers; and although most property owners take responsibility for <br />activities on their property, some property owners fail to take aggressive action, <br />or any action at all, to deal with such nuisance activities by people whom they <br />have allowed to live at, or visit, or conduct business at their property; and <br />WHEREAS, such repeated criminal activities greatly interfere with the <br />comfortable enjoyment of life and properly for the neighbors of such nuisance <br />properties, and lead to the deterioration of neighborhoods and the City as a <br />whole, as responsible property owners lose property value and move out of <br />neighborhoods and/or the City where such activity recurs; and <br />WHEREAS, the City of Lakewood has by ordinance declared and listed a <br />number of activities and conditions as nuisances, and has set forth administrative <br />steps in order to identify the properties that allow nuisance activities to occur <br />and to allow the City to recoup the costs of City services rendered; and <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this ordinance is an emergency measure, and that this <br />ordinance shall take effect at the earliest date possible as set forth in ARTICLE <br />III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that changes need to be made to the existing Criminal <br />Nuisance Ordinance to ensure the enforceability of this provision.
