<br />City of Lakewood, he or she shall, upon certification of such <br />inability by a medical professional and the approval of the <br />Director of Public Safety, be paid for a period not to exceed <br />ninety calendar days as if the part-time officer were working <br />their assigned hours. Hours eligible for payment shall be <br />determined based on the average numbers of hours worked per <br />pay period that the part-time officer worked over the prior six <br />months or first date of employment, whichever is shorter. <br /> <br />(2) In the event of any accidental death payment pursuant to this <br />subsection, the City shall be subrogated to all the part-time <br />officers rights of recovery therefore against any person or <br />organization, and the representative of the estate of such part- <br />time officer shall execute and deliver instruments and papers <br />and shall do whatever else is necessary to secure such rights. <br />Furthermore, such representative shall do nothing after payment <br />hereunder to prejudice such rights. <br /> <br />Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberation of the Council and <br />of any of its committees that resulted in such formal action were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br />Section 3. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual daily operation of the City <br />for the reasons set forth and defined in the preamble to this ordinance, and <br />provided it receives the affirmative vote of at least five (5) of its members <br />elected to Council, this ordinance shall take effect and be in force immediately <br />upon its adoption by the Council and approval by the Mayor otherwise, it shall <br />take effect and be in force after the earliest period allowed by law. <br /> <br />Adopted:Mu <br /> <br />I í, "?If) P <br />. <br /> <br />("') <br />~.:d-- <br /> <br />President of Council <br /> <br />-111 fÀAA 7, !/ tLòtÄ <br />clerkd Council <br />
