<br />(b) This section shall not apply to radioactive materials shipped or transported by or for the United States government for
<br />military or security purposes or which are related to national defense.
<br />1781.03 NOTICE.
<br />When those radioactive materials requiring a permit as specified in this chapter are to be shipped or transported into, within,
<br />through or out of the City, the shipper or cazrier, or person otherwise responsible, shelf first notify the Director of Public Safety or his
<br />designated representative, in a forth provided, not less than two weeks prior [o the date of shipment. The form shall include the date of
<br />shipment, Type and quantity of radioactive materials involved, method of transportation, route, startingpoint, destination and such other
<br />information as the Director of Public Safety or his designated representative may reasonably require. Any information which cannot be
<br />supplied two weeks prior to shipment or transportation, shall 6e supplied promptly by the person responsible for such shipment or
<br />transportation when such information becomes available to him. Nothing herein shad be construed as requiring the disclosure of any
<br />defense information or restricted data as defined in the Atomic Energy Act of 1954 and the Energy Reorganization Act of 1974, as
<br />amended.
<br />1781.04 ISSUANCE OF PERMIT.
<br />(a) The Director ofPublic SafeTy or his designated representative shall not issue a permit to any person for the shipment
<br />or transportation of those radioactive materials specified in this chapter, unless
<br />(1) There ie a showing that the radioactive material has been or will be containerized and packaged, and all
<br />warning labels affixed to the outer container holding the radioactive material and the motor vehicle
<br />transporting such material, in conformity with the regulations of the United States Department of
<br />Transportation, United States Nuclear Regulatory Commission or other related Federal or Stake agencies
<br />regardless ofwhether the shipment is being made infracity, intrstate or interstate; and
<br />(2) There is a showing that the shipment or transportation of radioactive materials is necessitated 6y urgent
<br />public policy or national security interests transcending public safety and health concerns of the City Eor
<br />the purposes of this section:
<br />A, An "urgent public policy" shall include medical and educational interests.
<br />B. An "urgent public policy" shall vot include interests other than medical and educational interests,
<br />unless expressly authorized in writing by the United States Department of Transportation, or by
<br />any other appropriate Federal or State agency which may be required by the Director of Public
<br />Safety or his designated representative. Such authorization shall state that the particular interest
<br />involved is, i¢ the opinion of the agency, permitted by Rederal or State regulations pertaining to
<br />the shipment or transportatlon of radioactive materials, and that the interest involved justifies the
<br />apparent risks resulting from such shipment or transportation.
<br />(b) Radioactive materials which are permitted to be shipped 6r transferred through the CiTy pursua¢t to this chapter shall
<br />be shipped or transported though the City over such route or routes, or at such time or times of the day, consistent with the public health,
<br />safety and welfare and the convenience of the shipper or tarsier, as the Director dF Public Safety or his designated representative may
<br />direct.
<br />1781.99 PENALTY.
<br />Any person who violates any provision ofthis chapter shall be guilty of a misdemeanor of the first degree,

<br />Inspection otPremises; Disposal of Garbage end Other Wastes
<br />1783.01 INSPECTION.
<br />It shall be the duty of the Chief of Police, the Commissioner of FIealth, sanitary officers and policemen, when they deem it
<br />necessary in order to secure or preserve the public health, to enter upon the premises or inte the house, manufactory, workshop or other
<br />place of any person within the CiTy to determine whether any nuisance exists therein, to inspect drains, vaults, cellars, cesspools, water
<br />closets, earth closets, cisterns, wells, privy vaults, sewers, yard and grounds of such premises, and to examine the condition of persons
<br />inhabiting or working in such places When satisfied that apartments used for lodging or working therein are damp, ill-lighted, ill-
<br />vevtilated, improperly constructed, or liable from overorowding or filth to become infected with infectious, malig¢ant, pestilan[ial or
<br />dangerous diseases, or are not properly provided with pure
<br />water, and with privies, water closets, sewers, drains or cesspools, such policemen or any of them shall serve a written notice upon the
<br />owner, agent, lessee, occupant, tenant or other person in charge of such premises to corset[ or remove the nuisance or objection therein
<br />named, and if such owner, agent, lessee, occupant, tenant or other person in charge of such premises neglects or refuses to obey such
<br />notice, the Chief of Police or the Commissioner of Health is hereby fully authorized to put the same in. proper order at the expense of
<br />such owner, agent, lessee, occupant, tenant or other person having charge thereof.
<br />1783.02 INFESTATION BY RODENTS OR VERMIN.
<br />No person shall permit any premises within the City to become or to continue to be infested with vermin or rodents.
<br />1783.03 NOTICE REQUD2ED; EXCEPTION.
<br />Whenever the Commissioner of Health shall ascertain that a nuisance affecting or endangering the public health exists on any
<br />premises, or in any house, manufactory, workshop or other place within the City, he shall notify in writing any person owning, teasing,
<br />occupying, having control of or acting as agent for such premises, house, manufactory, workshop or other place, m abate and remove
<br />such nuisance within a reasonable time to he stated in such notice. In case of necessity, such nuisance may be abated or removed by the
<br />Commissioner ofHealth without such notice,
<br />1783.04 ABATEMENT OF NUISANCES.
<br />Upon the neglect or refusal of any owner, lessee, occupant, agent or other person having control of any premises, house,
<br />manufactory, workshop or other place to comply with a notice to abate a nuisance, the Commissioner ofHeaith may abate such nuisance,
<br />and the owner, lessee, occupant, agent or other person having control of any premises, house, manufactory, workshop or other place, in
<br />addition to any other penatty provided in [his Sanitary Code, shall be liable to the City for the cost of such abatement or removal, to be
<br />recovered in a civil action before any court havingjurisdiction thereof.
