(b) Iv the event of a second citation for a violation of any provision of this chapter within six calendar months of a
<br />previous citation, the notice requirement under this chapter shall be twenty-four hours far correction, as opposed to the seven days
<br />required under subsection (a) hereof.
<br />1779.03 NOTICE.
<br />The notice referred to in Section 1779.02 shall be in writing, shall bear the date of issuance and shall be signed by the Mayor or
<br />Director of Public Safety or other individual authorized to enforce this Code. Any such notice may be served by regular mail or by
<br />delivery to such person or to [he premises affected by it by an employee of the City of Lakewood. Every such notice shall describe by
<br />street and number the premises which it purports to cover and shall state with as great particularity as possible under the circumstances
<br />the location and nature ofthe conditon which gives rise to such nuisance.
<br />1779.05 REMEDY OF CITY.
<br />(a) If the owner, lessee or occupant of any promises do the City fails or infuses, within sevav days after receiving avy
<br />notice hereinabove provided for, to abate the nuisance described in such notice, it may be abated by the City, through its employees and
<br />under the direction of the Mayor or Director of Public SafeTy. The cost of abating any such nuisance shall be charged to the owner of the
<br />property affected and in default of payment shall be assessed against such property. All charges and assessments hereunder shall be as to
<br />forms, notices, times, payments, collections and all other respects as are now or hereafter may be provided for charges or assessments for
<br />sidewalk repairs asset forth in Article XVI Section I9 of the City Charter
<br />(b) All charges and assessments made under authority of this section are in addition to any penalty that may be imposed
<br />under the provisions of Section 170L99 of this Sanitary Code.
<br />CHAPTER 1783
<br />Inspection ofPremises; Disposal of Garbage and Other Wastes
<br />1783.01 INBPECTI0N.
<br />It shall be the duty of We Chief of Police, police officers and [hose designated to enforce this code, when they deem it
<br />necessary in order to secure or preserve the public health, to enterupon the premises or into Ne house, manufactory, workshop or other
<br />place of any person within the City to determine whether any nuisance exists therein, to inspect drains, vaults, cellars, cesspools, water
<br />closets, earth closets, cisterns, wells, privy vaults, sewers, yard and grounds of such premises, and to examine the condition of persons
<br />inhabiting or working in such places. When satisfied that aparmtents used for lodging or working therein are damp, ilblighted, ilb
<br />ventilated, improperly constructed, or liable from overcrowding or filth to become infected with infectious, malignant, pes[ilentia( or
<br />dangerous diseases, or are not properly provided with pure water, and with privies, water closets, sewers, drains or cesspools, such
<br />policemen or any oP them shall serve a written notice upon the owner, agent, lessee, occupant, tenant or other person in charge of such
<br />premises to corsect or remove the nuisance or objection therein named, and if such owner, agent, lessee, occupant, tenant or other person
<br />in charge of such premises neglects or refuses to obey such notice, the Chief of Police or the Mayor or Director of Public SafeTy is hereby
<br />fully authorized to put the same in proper order at the expense of such owner, agent, lessee, occupant, tenant or other person having
<br />charge thereof
<br />1783.02 INFESTATION BY RODENTS OR VERMIN.
<br />No person shall permit any premises within the City to become or to continue to be infested with vermin or rodents.
<br />1783.03 NOTICE REQUH2ED; EXCEPTION.
<br />Whenever the Mayor or Director of Public SafeTy shall ascertain that a nuisance affecting or endangering the public health
<br />exists on any premises, or in any house, manufactory, workshop or other place within the City, he shall notify in writing any person
<br />owning leasing, occupying, having control of or acting as agent for such premises, house, manufactory, workshop or other place, to
<br />abate and remove such nuisance within a reasonable time to be stated in such notice. In case of necessity, such nuisance may be abated or
<br />removed by the Mayor or Director of Public Safety without such notice.
<br />1783.04 ABATEMENT OF NUISANCES.
<br />Upon the neglect or refusal of any owner, lessee, occupant, agent or other person having control of any premises, house,
<br />manufactory, workshop or other place to comply with a notice to abate a nuisance, the Mayor or Director of Public Safety may abate
<br />such nuisance, and the owner, lessee, occupant, agent or other person having control of any premises, house, manufactory, workshop or
<br />other place, in addition to any other penaly provided in [his Sanitary Code, shall be liable to the City for the cost of such abatement or
<br />removal, to be recovered in a civil action before any court havingjurisdiction thereof
<br />1783.05 RECEPTACLES FOR GARBAGE, REFUSE AND LITTER
<br />(a) The owner, agent, lessee oroccupant of any dwelling unit where refuse is produced or permitted to acwmulate shall
<br />provide an adequate number of containers for such refuse. Each container shall berat-proof, insec4proof, watertight, svucturally strong
<br />to withstand handling stress and easily filled, emptied and cleaned, Each container shall be provided with tight fitting covers and shall be
<br />maintained at all times clean and in sanitary and safe condition. Such container shall have a capacity of not less than twenty nor more
<br />than thirty-two gallons and shat) be provided with suitable handles.
<br />(b) For each tenement apartment house using City refuse disposal, there shall be at least two such receptacles for each
<br />apartment unit.
<br />(c) Each and every hotel, restaurant, cafe, lunch room, grocery, store, market, workshop or factory shall be provided with
<br />one or more ofsuch receptacles. No garbage shall be placed or permitted to remain elsewhere than in such receptacles.
<br />1783.06 COVERS FOR GARBAGE RECEPTACLES.
<br />No occupant or person in possession or control of any building provided with any such receptacle shall fail to keep the same
<br />tightly covered at all times except when garbage is being placed ffierein or removed therefrom.
<br />1783.07 LOCATION OF RECEPTACLES..
<br />(a) No person shall place or maintain any receptacle for garbage, ashes or rubbish so that i[ will be or constitute a
<br />nuisance
<br />ro) Receptacles for garbage, ashes or rubbish maintained for public collection shall be so placed as to be readily
<br />accessible for collection.
<br />(c) In an ML, MIi, Cl, C2, C3 and I zoning district, no person shall store refuse or garbage lawfully retained on the
