1722.02 DEFINTfIONS.. <br />The following definitions, terms, phrases, words and their derivations shalt apply to this chapter: <br />(a) "Health Commissioner" means the Health Commissioner of the Ciry of Lakewood, or his/her authorized <br />representatives. <br />(b) "Building Commissioner" means the Building Commissioner of the City of Lakewood or his/her authorized <br />representative. <br />(c) "Family swhmningpool° means an artifioial body of water acossory to either asingle-family or two~~family dwelling <br />house with any horizontal measurement ten feet or more and used or intended to be used solely by the owner or <br />lessees of such dwelling house or by his family or by friends invited to use it without payment of any fee. <br />(1) "Portable family swimming pout" means a family swimming pool resting entirely above ground and <br />designed to be easily dismantled, stored and moved ffom one place to another. <br />(d) "Family wading pool" means an artificial body of water accessory to either asingle-family ortwo-family house, with <br />a controlled water supply, with any horizontal measurement being less than ten feet and used or intended to be used <br />solely by the owner or lessee of such dwelling house or by his family or by friends invited to use it without payment <br />of any fee. <br />(q "Portable wading pool" means a family wading pool which maybe dismantled, stored or moved from one <br />place to another. <br />(2) "Permanent wading pool" means a family wading pool which is built either upon or below the level ofthe <br />ground and which is not designed or intended to be readily dismantled, stored or moved from one place to <br />another <br />1722.03 CONSTRUCTION PERMIT. <br />Before work is commenced on the construction of a family swimming pool or any alteration, additioq remodeling or other <br />improvement thereto, an application for a permit to construct and the plans and specifications and pertinent explanatory data hereinafter <br />required shall be submitted to the Building Commissioner for approval. No part ofthe work shall be commenced until the Commissioner <br />of Health and the Building Commissioner have evidenced their approval by a suitable endorsement upon such plans and specifications, <br />and have granted a permit thereof <br />1722.04 FEES. <br />(a) Permits The fea for the permit to covstruo[ a swimming pool shall be at the rate of four do0ars ($4.00) par 100 <br />square feet, or fraction thereof, ofthe ground area occupied by the pool structure, with a minimum fee of twenty~five dollars ($25.00). <br />Such fee is in addition to permit fees applicable to other structures which may be incidental to the pool, or plumbing, sewering or wiring <br />wnnectivns therewith. <br />(b) License. The fee for a license for a family pool shall be thirty dollam ($30.00). <br />1722.05 LICENSES TO OPERATE; TRANSFERABILITY; EFFECTIVE <br />PERIOD. <br />No person shall operate or maintain family swimming pool until a license therefor has been issued by the Commissioner of <br />Health. The license for a family swimming pool shall be issued for an indefinite period but shall not be transferable as to person or <br />location. All licenses shall be in writing and shall state the conditions thereof and the term for which the license is granted. It shalt be <br />unlawful for any person to conduct, opemte, maintain or manage any swimming pool without complying with the requirements of this <br />chapter, and the Divisions of Public Health and Building Inspection are charged with the enforcement of the provisions thereof <br />1722.06 REVOCATION OF LICENSE; APPEAL. <br />Any license granted by the Commissioner of Health hereunder may be revoked by him for failure to comply with rules and <br />regulations promulgated hereunder or for failure to comply with any provisions of tltis chapter, or whenever, in the determination ofthe <br />Commissioner of Health, further operation under such license creates a menace to the health, safety or morals of the users of the <br />swimming pool. The holder of any license which has been revoked may appeal to Council in writing within tlilrty days of such <br />revocatoq and Council shall, at ifs next regular meeting, determine the legality or reasonableness of the revocation. No appeal under this <br />section, however, shall entitle the license holder to continue opemtion ofthe swimming pool pending aa[ioq of Council. <br />1722.07 INSPECTION.. <br />The Commissioner of Health shall inspect or cause to be inspected all pools within the City at such times as he may deem <br />necessary to carry out the intent of this chapter. The Commissioner of Health, or his duly. authorized representatives, is authorized to <br />enter upon any premises, private or public, to take samples of water from the pools at such times as he may deem necessary and to require <br />the owner, proprietor or operator to comply with the provisions of this chapter. In the even[ of the failure of compliance, after due <br />notice, with any provisions of this chapter, the Commissioner of Health shall have the power to abate or cause a suspension ofthe use of <br />such pool until such time as the same is, in the opinion ofthe Commissioner of Health, no longer a menace or a hazard to health, safety <br />or morals. <br />1722.08 COMPLIANCE WITFI REQUlltEMENTS OF STATE DEPARTMENT <br />OF HEALTH. <br />In the conshuctioq operation and maintenance of any family swimming pool, laws of the Slate of Ohio. and the rules, <br />reguladons and requirements ofthe State Department of Health shall be observed. In the event of any conflict between the provisions of <br />this chapter and any provision of State law or requirement, rule or regulation ofthe Ohio Department of Public Health, the provision <br />imposing the higher standard or the more stringent requirement shall be controlling. <br />1722.09 SAFETY PRECAUTIONS. <br />All reasonable precautions shall be taken to protect the users of public and family swimming pools from injury or accident <br />Convenient means of ingress and egress shall be provided and the depth of water and any inegularities of [he bottom shall be clearly <br />indicated. SafeTy appliances such as lifebuoys, life-hooks, bamboo poles or ropes and equipment including fvst-aid kits shall be <br />provided and,be readily accessible. <br />1722.10 POLLUTION. <br />No body of water, whether natural or artificial, which contains sewage, waste or other contaminating or polluting ingreAients <br />rendering fhe water hazardous m health, or which otherwise fails to meet the requirements ofthis chapteq shall be used for swimming or <br />bathing purposes by any person. <br />1722.11 LIGHT ARRANGEMENT. <br />Lights used to illuminate any pool shall be so arranged and shaded as to reflect light away from adjoining premises and public <br />
