PLACED on In Reading in a Special Meeting of Council 6/9/08, 2"a Reading at Special Meeting of Council 6/10/08 ORDINANCE N0. 62-08 BY: Antonio, Bullock, Butler, Dever, Madigan, Powers, Summers. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council, otherwise, it shall take effect and be in force after the earliest period allowed by law, authorizing the Mayor (Director of Public Safety), the Director of Public Works, the Director of Law, the Director of Finance, and/or the Purchasing Manager to engage Ice Land USA -Lakewood LLC to lease and provide managerial services, and enter into a contract for Winterhurst Ice Rink. WHEREAS, the City of Lakewood (the "City") has received a Proposal from Ice Land USA-Lakewood LLC regarding the leasing and managing of Winterhurst Ice Rink that would significantly reduce operating costs of the City; and WHEREAS, the City desires to enter into a Contract with Ice Land USA-Lakewood LLC, for the leasing and management of Winterhurst Ice Rink; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of public property, health and safety, and to provide for the usual daily operation of municipal departments in that it is necessary and in the best interest of the City to enter into this contract. Now therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor (Director of Public Safety), the Director of Public Works, the Director of Law, the Director of Finance, and/or the Purchasing Manager is hereby authorized to engage Ice Land USA-Lakewood, LLC. to lease and provide professional services for the management of Winterhurst Ice Rink. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
