(a) Picnicking shall be restricted to those areas of the parks designated for <br />such purposes by the Superintendent of Parks. <br />(b) Use of the Kiwanis Pavilion and/or the Shelter House Pavilion situated in <br />Lakewood Park shall be by permit only issued by the Superintendent of Parks. The <br />permit applicant shall be a Lakewood resident of the age of eighteen years or older. <br />(c) No permit shall be issued to any individual representing a business <br />organization, civic organization, club or association, but excluding a family picnic <br />gathering, unless such organization, etc. is based within the City or its membership is <br />comprised of not less than fifty percent (50%) City residents; provided, however, for <br />the 1984 season a permit may be issued to a nonqualifying organization for weekday <br />use only if such organization has previously been issued a picnic permit for two out of <br />the prior three seasons, and for the 1985 season and thereafter a permit may be issued <br />to a nonqualifying organization for weekday use only if such organization had been <br />issued a permit for the immediately preceding year. <br />(d) Any application for the permit provided for herein who knowingly submits <br />false information or statements in the application shall be deemed guilty of a minor <br />misdemeanor. <br />(e) All picnic permit holders for groups of more than twenty-five ersons shall <br />deposit with the Superintendent of Parks the sum of twenty-five dollars (25.00) to <br />guarantee the cost of cleaning the premises after use and/or any damage to property <br />which may occur. <br />(f) Permittees shall be responsible for clean-up of the area of premises used <br />and for any damage caused to property. If the immediate area in which the picnic was <br />held is-not cleaned, or the cost of repair of property damage not remitted upon <br />demand, the Superintendent of Parks shall immediately cause such clean-up to be done <br />and/or the property damage to be repaired, and the permittee shall forfeit such deposit; <br />otherwise, such deposit shall be refunded to the permittee. <br />(g) All permittees shalt be liable for any loss or damage to property in excess of <br />any deposit made as provided for herein... <br />shall be and is hereby amended to read as follows: <br />905.15, Picnic Areas, Permit for use of Picnic Pavilions <br />(a) The Director of Public Works shall establish a list of picnic pavilions that <br />shall be available by permit only ("Permit Pavilion'. <br />(b) For the months of May through October those pavilions designated as <br />Permit Pavilions shall require a permit. However during the months of November <br />through April no permit is required. Permits shall be issued by the Director of Public <br />Works. The permit applicant shall be age eighteen years or older. Permit applications <br />shall be submitted on a form provided by the Director of Public Works. <br />(c) The applicant shall pay anon-refundable fee as established by Lakewood <br />City Council. The Lakewood Kiwanis shall not be charged a fee for use of the Kiwanis <br />Pavilion located'at Lakewood Park. <br />
