ORDINANCE N0. 4i-09 BY: Antonio, Bullock, Butler, Dever, Madigan, Powers, Summers. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, authorizing the Mayor to enter into an agreement with the Cuyahoga County Board of Commissioners for the improvement of Bunts Road from Lakewood Heights Boulevard to Clifton Boulevard. WHEREAS, the City of Lakewood recognizes the need for and proposes the improvement of a portion of public highway described as follows: The improvement of Bunts Road (CR-232) from Lakewood Heights Boulevard to Clifton Boulevard WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that this legislation is necessary to complete the Bunts Road reconstruction project. Now Therefore, BE 1T ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. A. CONSENT 1. It is declared to be in the public interest that the consent of the City of Lakewood be and such consent is hereby given to the County to construct the above improvement in accordance with plans specifications and estimates approved by the County. B. COOPERATION 1. That the City of Lakewood will cooperate with the County in the improvement of Bunts Road (CR-232) from Lakewood Heights Boulevard to Clifton Boulevard.
