PLACED ON 1 sr READING & REFERRED TO THE <br />PUBLIC SAFETY COMMITTEE 7/20/09. <br />ORDINANCE NO. 61-09 BY: Antonio, Bullock, Butler, Dever, <br />Madigan, Powers, Summers. <br />AN ORDINANCE to take effect immediately provided it received the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law, to authorize the Mayor to enter into <br />an agreement between the Cities Lakewood, Cleveland, Euclid and Cuyahoga County for <br />the interchange of pubic safety marine patrol services in support of the Northern Border <br />Initiative. <br />WHEREAS, the Cities of Lakewood, Cleveland, Euclid and Cuyahoga County <br />(hereinafter "Party Subdivisions' collaboratively staff the Cleveland Public Safety <br />Marine Patrol team in support of the Northern Boarder Initiative; and <br />WHEREAS, Ohio Revised Code §737.04 provides authority for municipalities to <br />contract for the interchange of police services; and <br />WFIEREAS, in order to collaboratively provide police protection and reduce crime, <br />it is the desire of the parties to this agreement to provide for and join in providing for <br />mutual assistance and the interchange of their respective personnel and equipment; <br />and <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this ordinance is an emergency measure, and that this <br />ordinance shall take effect at the earliest. date possible as set forth ih ARTICLE III, <br />SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, <br />and that it is necessary for the immediate preservation of the public property, health <br />and safety, and to provide for the usual daily operation of municipal departments in that <br />this agreement is necessary to immediately provide for mutual aid between the Party <br />Subdivisions. Now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That the Mayor be authorized to execute an agreement between <br />the Cities Lakewood, Cleveland, Euclid and Cuyahoga County for the interchange of <br />pubic safety marine patrol services in support of the Northern Border Initiative. <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br />
