SUBSTITUTE FOR ORDINANCE NO. 87- <br />09 PLACED ON 1sT READING & <br />REFERRED TO THE PUBLIC SAFETY <br />COMMITTEEE 11/16/09, 2ND READING <br />12/7/09. <br />ORDINANCE NO. 87-09 BY: Antonio, Bullock, Butler, Dever, <br />Madigan, Powers, Summers <br />AN ORDINANCE to create new Section 135.15 Administrative Towing Fees of <br />the Codified Ordinances of the City of Lakewood to establish an administrative fee for <br />the towing of vehicles ordered by the Division of Police. <br />WHEREAS, currently the City of Lakewood contracts with outside towing <br />agencies for police ordered towing of vehicles; and <br />WHEREAS, the owners of the vehicles towed pay the towing agency <br />directly for all costs associated with the tow; and <br />WHEREAS, the City of Lakewood expends a significant amount of time <br />processing paperwork for the tracking of and release of towed vehicles; and <br />WHEREAS, the Chief of Police has estimated that the City expends a <br />average of nearly $25.00 per tow in personnel hours; and <br />WHEREAS, the City of Lakewood would like to establish reasonable fees <br />for the administrative costs associated with the towing of vehicles. Now, <br />therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That new section 135.15, Administrative Towing Fees of the <br />Codified Ordinances of the City of Lakewood, is hereby enacted to read as follows: <br />135.15 ADMINISTRATIVE TOWING FEES <br />(a) An Administrative Towing Fee is hereby established and the City of <br />Lakewood, Division of Police is hereby authorized to charge an <br />administrative towing fee in the amount of $25.00 to the owner of any <br />vehicle seeking release of the vehicle from impound. The <br />administrative towing fee shall not be applicable in the event that the <br />vehicle is not returned to or claimed by the owner and shall be in . <br />addition to any fee that is charged by an agency that contracts with the <br />City ofLakewood for police ordered tows. Such fee may be increased <br />from time to time by the Director of Public Safety to reflect the actual <br />increase in costs associated with processing the police ordered tow of a <br />vehicle. The Director of Public Safety shall notify Council of such <br />
