ORDINANCE NO. 90-09 BYt Antonio, Bullock, Dever, Madigan, Powers <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and be in <br />force after the earliest period allowed by law, approving and accepting the Findings and <br />Recommendations as issued by Arbitrator Anna Duval Smith rendered In the Matter of Fact <br />Finding between the Lakewood Firefighters Association IAFF Local 382 and the City of <br />Lakewood issued on December 4, 2009. <br />WHEREAS, the Lakewood Firefighters Association filed a grievance and request for <br />Arbitration demanding an increase to the Hazmat stipend pursuant to the "Me Too" clause in <br />the Firefighter's contract. The claim was triggered by an increase to the Firearms stipend as <br />received by the Fraternal Order of Police in their 2007-2009 contract; and <br />WHEREAS, the parties were unable to resolve the grievance and reach an agreement <br />in the ensuing negotiations, thereby resulting in a Fact Finding hearing; and <br />WHEREAS, pursuant to the Fact Finder's Findings and Recommendations, the <br />current bargaining unit members would receive a lump sum payment of $1,250.00, and <br />retirees in 2008-09 would receive a lump sum payment of $750.00, and <br />WHEREAS, pursuant to the Fact Finder's Findings and Recommendations, the <br />language to the 2007-2009 Firefighter contract will not be modified; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and to <br />provide for the usual daily operation of municipal departments in that it is necessary and in <br />the best interest of the City to resolve claims against it in a timely manner. Now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That the City Council hereby approves and accepts the Findings and <br />Recommendations as issued by Arbitrator Anna Duval Smith rendered in the matter <br />between the Lakewood Firefighters Association and the City of Lakewood on December 4, <br />2009 setting forth a lump sum payment of $1,250.00 for current bargaining unit members <br />and $750.00 for retirees in 2008-09, without modification to the contract language. <br />
