PLACED ON 1ST READiIv~ & REFERED TO THE PUBLIC <br />SAFETY COMMITTEE 12/6/10, 2ND READING 12/20/10 <br />SUBSTITUTED ON THE FLOOR 1/3/11. <br />ORDINANCE NO. 107-10 BY: Bullock, Butler, ,Juris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law to amend Section 351.01, Limitations <br />on Parking, of the Codified Ordinances of the City of Lakewood to enact certain <br />subsections of this provision that were deleted as the result of a typographical error. <br />WHEREAS, in July Council adopted legislation that decriminalized parking within <br />the City of Lakewood; and <br />WHEREAS, during that process the entire Traffic Code was reviewed and <br />updated; and <br />WHEREAS, certain subsections of Section 351.01, Limitations on Parking were <br />deleted as the result of a typographical error; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that these <br />subsections are necessary to the proper enforcement of the Traffic Code. Now <br />Therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That section 351.20, Bust Stops; Taxicab Stands, of the Codified <br />Ordinances of the City of Lakewood, currently reading as follows: <br />351.01 LIMITATIONS ON PARKING. <br />No person shall stand or park a vehicle, except when necessary to avoid conflict <br />with other traffic or to comply with the provisions of this Traffic Code, or while obeying <br />the directions of a police officer or a traffic control device, in any of the following <br />places: <br />(a) On a sidewalk, curb or street lawn area, except a bicycle; <br />(b) In front of, or within three feet of a public or private driveway; <br />(c) Within an intersection; <br />
