313.11 PORTABLE SIGNAL PREEMPTION DEVICES PROHIBITED. <br />(a) 1 No person shall possess a portable signal preemption device. <br />~2~ No person shall use a portable signal preemption device to affect <br />the operation of a traffic control signal. <br />(b) Subsection (a)(1) of this section does not apply to any of the following <br />persons and subsection a 2 of this section does not apply to any of the following <br />persons when responding to an emergency call: <br />(1) or (19)e officer, as defined in Ohio R.C. 109.71(A)(11), (12), (14) <br />(2) A State highway patrol trooper; <br />3 A person while occupyymg a public safety vehicle as defined in Ohio <br />R.C. 4511.01(E)(1), (3) or (4). <br />(c) Whoever violates subsection (a)(1) of this section is uilty of a <br />misdemeanor of the fourth degree. Whoever violates subsection (a)(2) ofgthis section <br />is guilty of a misdemeanor of the first degree. <br />(d) As used in this section, °portable signal preemption device" means a <br />device. that, if activated by a person, is capable of changing a traffic control signal to <br />reen out of sequence. <br />~ORC 4511.031) <br />Section 3. That this ordinance shall be effective August 1, 2010. <br />Section 4. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br />Section 5. this ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety <br />and welfare in the City and for the usual daily operation of the City for the reasons set <br />forth and defined in the preamble to this ordinance, and provided it receives the <br />affirmative vote of at least five (5) of its members elected to Council, this ordinance <br />shall take effect and be in force immediately upon its adoption by the Council and <br />approval by the Mayor otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br />Adopted: ~ OQ`~ <br />President of Council <br />25 <br />
