PLEASE SUBSTITUTE FOR ORDINANCE NO. 45-10 <br />PLACED ON 1~ READNNG & REFERRED TO THE PUBLIC WORKS COMMITTEE 6/21/10, ZND <br />READING 7/6/10) <br />ORDINANCE N0. 45-10 BY: Antonio, Bullock, Butler, <br />Madigan., Smith, Summers. <br />AN ORDINANCE to take effect immediately provided it receives the <br />affirmative vote of at least five (5) members elected to Council, otherwise, it <br />shall be in effect and be in force after the earliest period allowed by law, to <br />strengthen ethical protections in the City of Lakewood against soliciting or <br />receiving improper compensation. <br />WHEREAS, it is vital to the health, safety, and long-term viability of the <br />City of Lakewood to keep Lake Erie water clean and free of raw sewage <br />overflows; and <br />WHEREAS, on-site storm water management could help our City sewer <br />district get into, and lower the cost of, compliance with Clean Water Act <br />requirements mandated by the U.S. EPA; <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, in the <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />Section 1. That 1306.29(c), which currently reads as follows: <br />1306.29 SAFETY AND SANITATION. <br />(c) All roofs of every dwelling and occupiable structure shall be maintained <br />weather- tight, water-tight, shall match and conform in their entirety to the <br />existing design and color, and shall be equipped with gutters and downspouts <br />connected to a public storm sewer, provided, however, with the approval of the <br />City Engineer, downspouts may discharge onto splash pads or other devices if a <br />nuisance shall not be created to adjoining property. <br />is hereby amended to read as follows: <br />
