54-10 Settlement w/ World West Ltd. for outstanding water bill

ORDINANCE N0. 54-10 BY: Antonio, Bullock, Butler, Madigan, Powers, Smith, Summers. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, authorizing the Director of Law to enter into a Settlement Agreement with World West Limited Partnership for an outstanding water bill that was incurred as a result of multiple water leaks. WHEREAS, World West Limited Partnership (World West) is the owner of properly located at 11750 Berea Road, Lakewood, Ohio; and WHEREAS, in February 2007, World West experienced a water leak at its property resulting in a water bill in the amount of $18,591.50; and WHEREAS, in March 2007, World West experienced an additional water leak resulting in a water bill in the amount of $102,194.87; and WHEREAS, World West had attempted to resolve the outstanding water bill with the City of Lakewood and the City of Lakewood participated in such discussions; and WHEREAS; ih May 2010 World West experienced an additional water leak at its property resulting in a water bill in the amount of $10,466; and WHEREAS, the total outstanding balance due from World West to the City of Lakewood as a result of these leaks is $131,252.37; and WHEREAS, it has been confirmed that the water from these leaks was not processed by the City of Lakewood wastewater treatment facility, but instead was wasted, thereby not resulting in additional waste water treatment charges by the City of Lakewood; and WHEREAS, the City of Lakewood paid an estimated $63,587 to purchase the wasted water from the City of Cleveland; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this
