The Flood Insurance Study referenced in Section 1308.07 identifies a segment within areas <br />of special flood hazard known as a floodway. Floodways may also be delineated in other sources <br />of flood information. The floodway is an extremely hazardous area due to the velocity of flood <br />waters which carry debris, potential projectiles, and erosion potential. The following provisions <br />apply within all delineated floodway areas: <br />(a) Prohibit encroachments, including fill, new construction, substantial improvements <br />and other development unless a hydrologic and hydraulic analysis performed in accordance with <br />standazd engineering practices demonstrates that the proposed encroachment would not result in <br />any increase in flood levels during the occurrence of the base flood discharge. <br />(b) If subsection (a) hereof is satisfied, all new construction and substantial <br />improvements shall comply with all applicable flood hazard reduction provisions of Section <br />1308.19. <br />(c) Any encroachment within the floodway that would result in an increase in base flood <br />elevations can only be granted upon the prior approval by the Federal Emergency Management <br />Agency. Such requests must be submitted by the Building Commissioner to the Federal <br />Emergency Management Agency and must meet the requirements of the National Flood <br />Insurance Program. <br />1308.99 PENALTY. <br />Whoever violates any provision of this Code or any rule or regulation promulgated <br />hereunder, or fails to comply herewith or with any written notice or order issued hereunder is <br />guilty of a misdemeanor of the first degree. Each day such violation occurs or continues to occur <br />shall constitute a sepazate offense. <br />Shall be and is hereby amended to read as follows: <br />1308.01 Title. <br />The provisions of this chapter, hereinafter referred to as this "Code" shall be known as <br />the Flood Damage Prevention Code of the City of Lakewood. <br />1308.02 Findings of Fact <br />The City of Lakewood has special flood hazazd areas that are subject to periodic <br />inundation which may result in loss of life and property, health and safety hazards, disruption of <br />commerce and governmental services, extraordinary public expenditures for flood protection and <br />relief; and impairment of the tax base. Additionally, structures that are inadequately elevated, <br />floodproofed, or otherwise protected from flood damage also contribute to the flood loss. In <br />order to minimize the threat of such damages and to achieve the purposes hereinafter set forth, <br />these regulations are adopted. <br />1308.03 Statement of Purpose <br />It is the purpose of these regulations to promote the public health, safety and general <br />welfaze, and to: <br />(a) Protect human life and health; <br />11 <br />
