(jj) "Substantial Improvement" means any reconstruction, rehabilitation, addition, or other <br />improvement of a structure, the cost of which equals or exceeds 50 percent of the mazket value <br />of the structure before the "start of construction" of the improvement. This term includes <br />structures, which have incurred "substantial damage", regardless of the actual repair work <br />performed. The term does not, however, include: <br />L Any improvement to a structure that is considered "new construction," <br />2. Any project for improvement of a structure to correct existing violations of state or <br />local health, sanitary, or safety code specifications which have been identified prior to <br />the application for a development permit by the local code enforcement official and <br />which aze the minimum necessary to assure safe living conditions; or <br />3. Any alteration of a "historic structure," provided that the alteration would not <br />preclude the structure's continued designation as a "historic structure". <br />(kk) "Variance" means the grant of relief from the standards of these regulafions consistent with <br />the variance conditions herein. <br />(Il) "Violation" means the failure of a structure or other development to be fully compliant with <br />these regulations. <br />1308.11 Designafion of the Floodplain. Administrator <br />The Assistant Duector of Public Safety, or the Building Commissioner or an Assistant <br />Building Commissioner or his or her desi ng ee (for the yumoses of this section, the <br />"Building Commissioner") is hereby appointed to administer and implement these <br />regulations and is referred to herein as the Floodplain Administrator. <br />1308.12 Duties and Responsibilities of the Floodplain Administrator <br />The duties and responsibilities of the Floodplain Administrator shall include but are not <br />limited to: <br />(a) Evaluate applications for permits to develop in special flood hazard areas. <br />(b) Interpret floodplain boundaries and provide flood hazard and flood protection <br />elevation information. <br />(c) Issue permits to develop in special flood hazard azeas when the provisions of these <br />regulations have been met, or refuse to issue the same in the event of noncompliance. <br />(d) Inspect buildings and lands to determine whether any violations of these regulations <br />have been committed. <br />(e) Make and permanently keep all records for public inspection necessary for the <br />administration of these regulations including Flood Insurance Rate Maps, Letters of <br />Map Amendment and Revision, records of issuance and denial of permits to develop <br />in special flood hazard areas, determinations of whether development is in or out of <br />special flood hazazd azeas for the purpose of issuing Foodplain development permits, <br />elevation certificates, variances, and records of enforcement actions taken for <br />violations of these regulations. <br />(f) Enforce the provisions of these regulations. <br />19 <br />
