Section 2. That Section 335.072(b), Driving Under Financial Responsibility Law Suspension or Cancellation, of the Codified Ordinances of the City of Lakewood, currently reading as follows: 335.072 DRIVING UNDER FINANCIAL RESPONSIBILITY LAW SUSPENSION OR CANCELLATION. (b) Whoever violates this section is guilty of driving under financial responsibility law suspension or cancellation, an unclassified misdemeanor. The offender may be fined up to one thousand dollars ($1,000) and pursuant to Ohio R.C. 2929.27 additionally may be ordered to serve a term of community service of up to five hundred hours. If the offender previously was convicted of or pleaded guilty to two or more violations or this section or a substantially equivalent municipal ordinance within the past three years, the offense is a misdemeanor of the first degree. The court shall impose a class seven suspension of the offender's driver's or commercial driver's license or permit, or nonresident operating privilege for the period of time specified in division (A)(7) of Ohio R.C. 4510.02. shall be and is hereby amended to read as follows: 335.072 DRIVING UNDER FINANCIAL RESPONSIBILITY LAW SUSPENSION OR CANCELLATION. (b) Whoever violates this section is guilty of driving under financial responsibility law suspension or cancellation, a first degree misdemeanor. The court shall impose a class seven suspension of the offender's driver's or commercial driver's license or permit, or nonresident operating privilege for the period of time specified in division (A)(7) of Ohio R.C. 4510.02. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. -3-
