Section 2. That Section 335.072(b), Driving Under Financial Responsibility Law <br />Suspension or Cancellation, of the Codified Ordinances of the City of Lakewood, <br />currently reading as follows: <br />335.072 DRIVING UNDER FINANCIAL RESPONSIBILITY LAW SUSPENSION OR <br />CANCELLATION. <br />(b) Whoever violates this section is guilty of driving under financial responsibility law <br />suspension or cancellation, an unclassified misdemeanor. The offender may be fined <br />up to one thousand dollars ($1,000) and pursuant to Ohio R.C. 2929.27 additionally <br />may be ordered to serve a term of community service of up to five hundred hours. If <br />the offender previously was convicted of or pleaded guilty to two or more violations or <br />this section or a substantially equivalent municipal ordinance within the past three <br />years, the offense is a misdemeanor of the first degree. The court shall impose a class <br />seven suspension of the offender's driver's or commercial driver's license or permit, or <br />nonresident operating privilege for the period of time specified in division (A)(7) of Ohio <br />R.C. 4510.02. <br />shall be and is hereby amended to read as follows: <br />335.072 DRIVING UNDER FINANCIAL RESPONSIBILITY LAW SUSPENSION OR <br />CANCELLATION. <br />(b) Whoever violates this section is guilty of driving under financial responsibility law <br />suspension or cancellation, a first degree misdemeanor. The court shall impose a class <br />seven suspension of the offender's driver's or commercial driver's license or permit, or <br />nonresident operating privilege for the period of time specified in division (A)(7) of Ohio <br />R.C. 4510.02. <br />Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br />-3- <br />
