Placed on 1st Reading & Referred <br />to the Public Safety Cmte. 11/1/10. <br />2ND READING 11/15/10. <br />ueferred 12/6/10. <br />ORDINANCE N0. 76-10 BY: Antnio, Bullock, Butler, <br />Madigan, Powers, Smith, Summers. <br />AN ORDINANCE to take effect immediately provided it received the affirmative vote of <br />at least five (5) members elected to Council otherwise, it shall take effect and be in force after <br />the earliest period allowed by law, requesting Council's specific approval of and authorizing the <br />Mayor to enter into an Addendum to and Renewal of Lease for property located at 17415 <br />Detroit Avenue, Lakewood, Ohio for use by the Division of Police ("Division's as the Ward I <br />Neighborhood Police Station, in accordance with Lakewood Codified Ordinance §111.04(a)(4). <br />WHEREAS, Council previously approved a two year lease of office space to establish a <br />neighborhood police station located at 17415 Detroit Avenue; and <br />WHEREAS, this lease will expire on December 31, 2010; and <br />WHEREAS, maintaining this location as a neighborhood police station will allow the <br />police continue to continue a visible presence on Detroit Avenue in Ward I; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the <br />immediate preservation of the public property, health and safety, and to provide for the usual <br />daily operation of municipal department in that this Addendum and Renewal of Lease must be <br />executed prior to the expiration of the current agreement. Now Therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. Lakewood City Council hereby authorizes the Mayor to enter into a <br />an Addendum to and Renewal of Lease for the lease of property consisting of a first <br />floor storeroom and basement located at 17415 Detroit Avenue, commencing January <br />1, 2012 for a two year term. <br />Section 2. Lakewood City Council hereby specifically approves the Addendum <br />to and Renewal of Lease by and between Albert Stratton dba Acorn Management Co., <br />17439 Shelburne Rd., Cleveland Hts, OH 44118 and the City of Lakewood, Ohio, 12650 <br />Detroit Avenue, Lakewood, Ohio (attached hereto as Exhibit "A"). The original Lease <br />Agreement, dated December 16, 2008 is attached hereto as Exhibit "B." <br />Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open meeting of <br />this Council, and that all such deliberation of the Council and of any of its committees that <br />resulted in such formal action were in meetings open to the public in compliance with all legal <br />requirements. <br />
