No. Lz-11 By: enderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />An Ordinance to amend Section 1129.06 Minimum Yard Requirements for <br />Principal Uses; Section 1121.04, Conditionally Permitted Uses; Section 1123.04, <br />Conditionally Permitted Uses of the Codified Ordinances of the City of Lakewood to <br />correct prior drafting errors and to keep these sections consistent with other provisions <br />of the Code. <br />Whereas, Section 1129.06 of the Zoning Code was not updated to reflect a <br />maximum 5 foot set back on Madison Avenue and Detroit Avenue when the Building <br />Line Map was amended to reflect those maximum setback requirements; and <br />Whereas, Sections 1121.04 and 1123.04 list mixed use overlay districts as <br />conditionally permitted in RS and R2 residential districts while Section 1135.04, Location <br />of Mixed Use Overlay District clearly only permits such use in Commercial and Public <br />School districts. Now therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That Section 1129.06 Minimum Yard Requirements for Principal <br />Uses of the Codified Ordinances of the City of Lakewood, currently reading as follows: <br />1129.06 MINIMUM YARD REQUIREMENT FOR PRINCIPAL USES. <br />In Cl, C2, C3, and C4 Commercial Districts, each zoning lot shall maintain the <br />minimum front, side and rear yard specified in Schedule 1129.06, except as otherwise <br />provided for in this Section. Each yard shall be unobstructed by a principal use, <br />including outdoor storage of goods, supplies and equipment as permitted in this <br />Section, or a principal building, except as otherwise provided in this Code. Such areas, <br />together with all other portions of the zoning lot not covered by permitted structures, <br />shall be landscaped with grass, trees, shrubbery and/or other appropriate ground cover <br />or landscaping material, which at all times shall be maintained in good and healthy <br />condition so as to assure adequate screening of parking and loading areas, as well as <br />absorption of rainfall. <br />SCHEDULE 1129.06: MINIMUM YARD REQUIREMENTS <br /> Cl OFFICE C2 RETAIL C3 GENERAL <br />BUSINESS C4 PUBLIC <br />SCHOOL <br />Front Yard Depth As established on the Bui/ding Line Map <br />Rear Yard Depth One-half (~/z) the height of the building, but in no case less <br />
